The Harbor Commissioners held a lively session yesterday afternoon. Commis- sioner Chadbourne held to his ruling that no contractor should receive a prozress payment unless the contractorshowed due diligence. This he considerel had not been donme and in consequence no war- rants were signed. Tuesday last the men employed on the new building were clam- orous for their money, but there were no funds with which to pay them. A general howl followed and the Commissioners met in session yesterday to settle the matter. Chadbourne preseated his side of the case and then Msjor Harney poured oil on the troubled waters. He pointed out that each of the contractors had been working under ditficuities, and when the represen- latives of the various firms got up and promised todo better Commissioner Chad- | bourne agreed to sizn the warrants for last month’s work. Extra men have been put to work and the chances are the de- pot will be completed and dedicated before the new year. In that event the names of Colnon, Chadbourne and Harney will appear on the cornersione, and there will thus be one Republican’s name which will go down to {uture generations. The chances are, however, taat Chadbourne will be euchered, and which will appesr on the column next March will be those of Democrats. Thomas Cruse, a Carpenter, Breaks Into Her House and Attacks Her, Passers-by Heard Her.Screums and Dragged Her Out of His Clutches. Thomas Cruse, a carpenter living at 139 Guerrero sireet, was before the In- eanity Commissioners yesterday morning, but the hearing of the case was postponed till his brother reached the City in a day or two, Kruse had been acquainted for some months with Miss Esther Mackie, 510 Fourteenih street, a sister of Policeman James Mackie. She was alone in the house Tuesday morning, when Cruse made his appearance. The front door was locked, but Uruse broke open the door, and on Miss Mackie hurrying along | the hallway to tee what was the matter Cruse seized her by the throat and en- deavored to drag her down the stairway to the cellar, at the sume time sbouting for some one to bring bhim an ax, as he meant to kill her. The lady’s loud screams attracted the attention of men from Buckman’s camp, who ran to her aasistance. When they reached the houte Cruse was dragging Miss Mackie into the basement, where he | knew an ax was kept. The men made 2 | rush upon the madman and threw him to the floor. He stiuggled desperateiy, bui was held till the police were nonfied, and he was sent to the Receiving Hospiial, where he was locked up in a padded cell. Miss Mackie is now suffering from nervous prostration due to the shock, but was uble to be around yesterday. Previous to hisattack upon Miss Mackie, Cruse had terrorized the neighborhood. He attacked a man on Guerrero street, and throwing him down sattempted to beat his brains out by bumping his head on the hard pavement. The man was rescued just as Cruse was dragging him in tne direction of the car-tracks as an electric-car was approeching. Cruse’s fit of madness is attributed by his friends to the want cf sieep. For sev- eral days and nights he bas been nursing his dying motber and for three or four nights bad been without any sieen. He is devotedly attached to her, and ihe con- stant strain shattered his mind. The doctors at the hospital say that Cruse is «uffering from acute mania eaused by lack of nourishment and want of sleep. 1n other words he 1s a raving maniac and unless he can get sleep aud take plonty of nourishing food he will die. A Very Fine Point Made in Deciding a Mandamus Oase Alameda County. From The Supreme Court has punched an- other hole in one of the laws enacted by the late Legislature.The Clark road law was intreduced by Assemblyman Clark of Ala- meda, and provided for the elsction of boards of trustees to take charze of all road matters, the law to go into effect sixty davs aiter approval. This time fell on May 31 of this year. Italso provided that the election of trustees should take place on the last Saturday of May. Bya strange fate the jast Saturday of May fell on the 29th, or two days before the new law was to go into cffect. The Supervisors of Alameda County construed this to mean that the election should be held, on the date set. of the next year. On this conciusion they vroceeded o go on with the road work under the old law and directed the superintendent of the Piedmont road district to have certain work done that amounted to about $50. The work was performed by several men, wh o assigned their claims for the payment for the work to Fred A. Davis, who upon receiving the order for the mouney from the Supervisors applied to the County Auditor for the warrant. This the Auditor refused to give and Davis applied to the Supreme Court for a writ of mandate to | compel the Auditor to issue the warrant. | Tie Supreme Court detided the matter 7esterday, but in order to do so it had to resort to what might be called hair svlit- ting. As stated the whole thing hung on the matter of precedence. The first was to find when the Governor signed the two biils, and itseems the Governor’s signa- ture was affixed to both bilis on the same aay. The next move was a searc: which developed the fact that the Clark road law was recorded on page 374 of the statutes of 1897 and that the county government bill appears on page 452 of the same statutes. As the latter repealed all previous acts the Supreme Court decided that the Clark road law does not hoid in this case. In fact it was virtually repealed by tbe form- er act. Consequently the writ of mandate was issued as prayed for by Mr. Davis and a big kole was made in the much-taiked- of Clark road law.
