THE SAN FRANCISCO CALL, THURSDAY, JULY 29, 1897 BLAGKMALL B ONLY DEFENSE The Case Against Thomas Stanton Was Dis- missed. He Was Charged With Selling | an Obscene Book on May 29. The Defendant Flatly Contradicts the Evidence of Lucas' Pri- vate Detectives. The trial of Thomas Stanton, clerk in Warren E. Price’s bookstore, 1203 Market street, charged with selling obscene books, was concluded before Judge Low yester- day, resulting in the case being dis- missed. The case for the prosecution was closed Tuesday, and terday afternoon Attor- ney Eagene Deuprey put witnesses on the stand {0 back up his assertion that the whole thing a piece of blackmail on the part of Private Detective A. Lucas. The first witness called was Miss Char- lotte Cross, stenographer for Lucas, but her evidence was unimportant. Then fol- lowed W. G. Taffinde:, who testified that | ne called upon Mrs. Thomas, Price’s | mother, at the bookstore, and in a friendly | wav suggested that she should settle with Lucas and put an end to the troubls be- | tween them. He was not influeaced by any one to make the suegestion. Mrs. Blakiston testifieu that she heard a conversction between her husband and Mrs. Thomas in which her husband toid Mrs. Thomas that Lucas was willing to settle with her on payment of $.4 50, the amount due Lucas’ lady friend from the purchasing club, and $53 for attorney fees. Mrs. Thomas testified that on two occa- | sions demands had been made uvpon her to go to Lucas’ office. She went once but did not see tim. Miss Cross, Lucas’ type- writer, called upon her at the bookstore and told her it would be to her interest to be at Lucas’ office at 11 o’clock that day, but she did not go. Then she received a letter from Lucas in which the demand was made for §8 and this was followed by a visit from Blakiston, who made a similar demand. She was shown the book alleged to nave been purchased from Stanton on May 29 by Bostian, one of Lucas’detectives, and declared that such a bock was never in her premises. Taflinder came to her and ad- vised her to pay the money to Lucas, something less than $100, but she declined 10 do so. She saw Bostia the siore on June 12, and he told her Lucas had sent him to see her. Lucas wanted bis money, but she told Bostian she did notowe Lucas a cent. Bostian then said that Lucas would take the matter before the Council of the American Protective Asso- ciation, to which he and her son be- longed, and also give it to the newspapers. At the time ber son got into trouble wit- ness bad a penny-purchasing club, but she transferred it to another party last March. Lucas had a particular lady friend-who was a member of the club, ana it was her money that he wanted. The statements of Bos- tian and the other two witnesses for the frosecution were entirely false. ~ In cross-examination he said he bad been sentenced for burglary, but was par- doned by the Governor. Robert Johnsion testified that he knew Lucas snd was a member of the same council of the American Protective Asso- | ciation. Ames of New York, the ex- pert examiner of forged and disputed | handwriting, who arrived here to testify in the Craven suit, with Expert Carvalbo, was called upon yesterday by the prosecu- tion in the trial of Theodore A. Figel. The Isaac Hoffman receipt for $9500 was the subject under scrutiny, the witness disagreeing radically with his associate, Carvalho, as to the genuineness of the signature. Witness refused to express his opinion of David Carvalho as an expert, prefer- ring to acknowledge that their profession was not an exact science. [ would not place it alongside of math- ematics, for instance,” added the witness. “But look here, professor,’”” asserted the court, *'I would like to know more about Professor Carvalho.” cre was a general objection on the part of the prosecution, and the court ex- plained its reason for seeking informa- tion. -‘Atnoon te-day I asked Professor Ames about Carvalho, and he said that ne had no very great experience as an ex- pert; that he was only a picture-taker in the witness’ galiery. rvatho,” continued Judge Campbell, “examined the receipt 1n my presence last week, and, having finished, retir.d to | the other ena of the room with Judge Louderback. I did notlearn then of his decision, und, as_he was not cailed 1o the stand, but went East, I surmised that his opinion was adverse to the defense until I was confronted with his letter that he regarded the signature s genuine.’” It was finally decided to strike out all testimony 1n regard to Carvalho. Witness stated that his opinion, deli ered in a nun:ber of cases, had been re- versed. However, in these cases he had delivered no positive opinion. Tne defense endeavored to get in evi- dence through the v ‘o his con- nection with the Alonzo Whitman case some years ago in New York. Whitman, s0 1t is told, was in trouble with the banks of New York and Brooklyn. The expert testimony of Ames had vir- tually convicted him of forgery until the defendant’s attorney, who knew of a Brookiyn preacher whose writing resem- bled Whitman's, wrote to him a letter that brought back an answer. Part of the lat- ter was shown to Expert Ames, who said it was in Whitman’s handwriting. The preacher was put on the stand and acknowledged the authorship, and the in- security of expert testimony caused a re- versal of the situation, Whitman being promptly acquitted. When Genersl Barnes ‘asked Ames about his connection with the Whitman case he testified that only two words of the letter had been shown to him, and these he declared might have been writ- ten by Whitman, but he did not makea positive assertion of opinion. As corroborativa of his opinion that the $9500 receipt was a forgery, witness illus- trated on the blackboard how each letter of the signature ciffered in characteristics to the letters in the signatures accepted as genuine. In addition, he pointed out that the signature had been written on the re- ceipt first, atter which the paper had been folded to be reopened later, when the body of the receipt was written. The fola- ing of the receipt, according to the wit- ness, distarb the fiber of the paper to sufficient extent that wnere the ink passed over the folds 1t was absorbed and showed on the other side. Four tiny specks of dark color were observable under ihe mag- nifying glass to prove or corroborate the opinion of the witness. On cross-examination, however, General Barnes brouzht out that only four specks could be observed, while there were nine places where writing had been done over the creases. The witness accounted for this on the presumption that the otler places had been touched with a blotting pad, while the four that appear inked es- | caped the pad. This inking proposition on the back of the receipt is viewed in two ways accor- ing to whether it is the pros:cution’s or the defense’s point of vantage that is taken. The defense has already established that the receipt had been taken from Fig 1 against his will by Elward 8. Rothcehild. | Since that time the defendant’s demand for its return has been denied, and a few days ago the court took the document into its possession to be handled hence- forth only when in oven court. The de- fense now views with suspicion the black specks that appear on the back of the re- ceipt, as they believe they might have been placed there after the paper left Figel’s hands. e case will be resumed this morning.
