WHEELER GIVES HIS VERSION One of the Attorneys for| the Fair Heirs Takes the Witness-Stand, 1 He Disputes the Interpretation of the Interviews With Mrs, Craven, Spends the Whole Day on the Stand | Relating a Story That Has Been Often Heard Before. Attorney Charles 8. Wheeler, who rep- resents one of the Fair heirs as an inter- venor in the Fair-Craven ltigation, occupied the witness-stand throughout yesterday’s session of the great trial, He told nothing new—that is, nothing | new that could be expected from the hos- tile side. He was called for the purpose | of giving his version of the interviewa he had with Mrs, Craven durinz those months in the years of 1835 ana 1896, when the lawyers who are now fighting the so- called “pencil” will of the late James G. Fair were so enthusiastic over that docu- ment and were 80 anxious to have it pro- bated. Wheeler said that Mrs, Craven told him | that Senator Fair gave her two wills, one | in ink and the other written with & lead | pencil. Both were identical. I asked Mrs. Craven to tell me what she had done with the documents nfxer; Senator Fair had written them,’’ said he, | “‘and she told me that after the two copfes | had been revised and found to be alike sbe put them in a book and laid them away. They were, she saia, subsequently removed to a trunk. I asked her when she next saw the pencil or pen wills and she said that after Senator Fair's death a will was filed and she naturally thought that it was his last will. It was not, how- | ever, until she examined the documents she bad that she tound that they were of | a later date. She examined them, she saia, in the presence of Mrs. Elizabeth | That lady advised her to burn them Wheeler declared that never told him anything about Sepator Fair baving given ber any deeds to his| property. All she told him, he said, was that she was sure that the Senator had ! provided for her and that some deeds would be found either in the Senztor’s of- fice or in the possession of Attorney Good- fellow, | “When did you next see Mrs. Craven?”’ was asked. I told her that I ac- cepted her statements as made in good | faith, but that it was only fair to have the imatter thoroug: ly investigated. I asked her for more particulars, and especiaily with regard to the execution of the will on September 24, 1894, for I toid her that | Senator Fair was Sap Rafael on that day. Shesaid she was positive that the date was correct, and that she could prove it by a memorandum she had made in one of the books.” It was the old story over again. The only point on which Wheeler's version differed from that of Mrs. Craven was in reference to the deeds, he claiming that she never spoke of them to him. He nlso | denied that Mrs. Craven told him that Fair tcok the deeds out of his pocket and nhanded them to her with the remark that | he had vrovided for her in ‘‘another way.” All she ever told him in that re- | gard, he said, was that the Senator made the remark that he ‘‘could’’ provide for ber in another way.” HE WANTS TO MAKE TP Elva Croix Seabrook Says She Is Satis- fied With Single Blesscdness. Mrs. Seabrook de- nied that anything was contempiated at present and >aid that the matter wus en- tirely in the hands of her attorneys, Lowe & Hnmme|, of New York, who were look- ing after ner interesis. She said: “You know we are boin Catholics and there can be no absolute divorce. Tie New York courts, when we were legally separated somethmg more than a vear | ago, decided that he was to pay me $40 a week, and he has failed to do this, but he has been compelled to keep out of New York State. He wentout as a star and said that he failed to make money and went into court to ask that he be released from paying me, a3 I have a zood engage- ment here and am making a good living. | The courts again decided against him and he must still stay away or pay me. | “So far as Mr. Seabrook is concerned, I received a telecram from him only a few days ago in which he told me that he had received a new engagement. That shows | that he has nothing against me. I think | he would like to make up, but there i3 no | inclination of that sort on this side of the house.
