The witness soon afierward left the stand and Mr. Black addressed the court. He stated that Mr. Cormac had formerly consented to aliow him to examine his transcription of the testimony hitherto taken, but had afterward withdrawn tuat permission on consuitation with his col- lesgues. The prisoner, Mr. Black pointed out, was_a poor man without means, and he, Mr. Black, would, therefore, ask his Honor whether counsel for the aefense could obtain a copy of the testimony from any other source. Tre court said tnat the original depos tions and the oral evidence wouid be placed in the custody of the court as soon as they could be transcribed by the re- porter and that when this was done coun- sel cou!d have access to them, Mr. Black, on the understanding that he might bave forty-eight hours in which to | prepare his argument, consented to allow the testimony in the Preston case to be admitied in the Lee Weller case. He recognized the name Lee Walier as the prisoner’s handwriting, but was sure that the name Frank Harwood had not been written either by the prisoner or by Lee ‘Weller. Con- stable Conroy, who followed, said the prisoner when he knew him wore a silver watch and chain, and ibat the gold watch and chain found amon: the prisoner’s ef- fects closely resembled those worn by the murdered Lee Weller. The witness also stated that he obtained the prisoner’s hat from the forecastle when the arrest took place, but did not examine it very care- fully. Detective Egan deposed to the discovery of the white powder inside the sWeatbund and expressed the opinion that the pack- | age must have lain there for some time, | as it was pressed quite flat. A. McBoy e, a lic-nsed pharmacist, com- municated the result of an anaiysis of the | powder in question. He had made, he | said, & conciusively satisfactory test, in accordance with his experience of thirty | and upon learning that the powder mizht be material evide n the case he applied what was known as the color test, which was so fine and accurste that the allest fruction of a grain could be de- tected by it. He found that the powder contained six or seven grains of stry nine—enough to kill five men. The Bill for It« Enlargement Under Careful Considerstion. The Justices of the Supreme Court and the committes of the Bar Association held another meeting Wednesday to discuss the propused legislative bill for the enla:ging of the Supreme Court. One poin: agreed upon was for three District Courts of Apveal with three Judges each instead of one Appellate Court with five Justices. The matter of jurisdiction of the several courts was also agreed upon, the Supreme Court to uave supervisory control over the Appellate courts only in cases of ciash of | derisions, writs of mandate, probibition, etc. One section, if approved by the peo- ple, will do away with the necessity of extra Superior Judges in this City.” It provides that there may be as many ses- ons of the Buperior Court as there are Judges to hold court. Several were of the opinion that this would not be practicatle, owing to the court being beld in different cities. Itis expected that the different points will be harmonized, so as to submit the draft of the bill to the Legis- lature by to-morros.
