Putnam of Chadron, Dawes county, Neb,, has brought suit against the Mutual eRserve Life Fund Assoclation of New York in the United States circult court for $7,460 damages and interest from' Feb- ruary 1, 1868, and costs of action. The sult is transferred from the district court of Dawes county and the petition states that the plaintift was insured in the defendant company for the sum of $,000, and that upon his protesting against the payment of exvessive assessments his policy was can- celled by the company. The plaintiff had been Insured in said defendant company and paid all the premiums or mortuary as- sessments required by his original contract with the company. In making the assegs- ment on February 1, 188, the defendant did not make the assessment equal or ratably upon all policy holders, and pretended to make an assessment on the plaintiff and other policy holders who had taken out taelr tnsurance prior to January 1, 18%, on a basis other and more different and more enormous than was assessed and demanded of policy holders who had taken out thelr insurance subsequent to January 1, 180, which was unwarranted and without con- sent of plaintiff. No legal assessment wi made upon plaintiff's volley of Insurance since February, 188, and the cancellation of sald policy wholly vnwarranted by said company, he having up to that time paid $90.76 in premiums. Hence by the cancellation of said policy the plaintift has lost all consiceration for sald payments and has been damaged in the amount asked in this petition. And further on ac- count of his advanced age he will now be unabla to procure another policy of in- surance in any company except at an ex- orbitant rate therefor.
