NONRESIDENT PUPILS EVADE THE LAW Guardianship Resorted To in Order to Bscape Payment of Small Sum Exacted for High School © School and school board officers are vexed about the way nonresident students are obtaining free tuition in the High school and are trying to find a way to stop the practice. The enforcement of the rule requiring all nonresident students to present papers showing they have guardians residing in Omaha has ceased to be ef- fective, and now It is delared the way to reach. the abuse s to check the issuance of suardianship papers. At the present time, as estimated, from ten to fifteen young men and women are at the High school who merely come to Omaha during the school year, Hve with relatives and attend school. Some of the students come for miles and a few have parents paying taxes in lowa. By spending & amall fee to have the relative with whom they reside appointed guardian, the yearly tultion of M7.60 is saved and the benefits and advantages of the local High school obtained for nothing. Unfair to Taxpayers. Principal Waterhouse has called the mat- ter to the attention of the secretary of the Board of Education. “It is unfair to the taxpayers of the schodl district,” said Mr. Waterhouse. “I have no objection to the outside students attending school It they pay the tuition, but evasion by the guardi- anship expedient should not be counte- nanced 1f we can help it." A number of the children who attend the High school by virtus of this proceeding are relatives of wealthy citizens who have preferred to evade the imposition of the charge for' tutelage. Yesterday a young man appeared in the office of the school board with the statement that Principal Waterhouse had sent him down for a note showing that tuition had been paid for him or that he was a ward of a resident. COUNCIL QUICKLY ENDORSE THE IDEA When No Property is Found by Dis- tress Warrant Civil Action with t Attachment Will Be Bad. A new wrinkle in coliecting delinquent personal taxes is to be tried by City Treas- urer Hennings, with the sanction of the council. It is designed to catch persons who have at one time possessed personal property, but who have sold it, and decline to pay the accrued taxation sharges. Without tangible property in sight the treasurer cannot work his old plan of forcing payment by the furniture van. There are scores of such taxes on the books, and if the first case is carried through successfully the plan will be made to operate against similar delinquents who owe the city money. After issuing a distress warrant and hav- ing it returned with the Information that the individual against whom it lies has no personal property, the treasurer will ask the council to pass & concurrent resolution authorizing him to bring civil action to cover the taxes. In this way collection may be made by garnishment of wages, if necessary, and the municipal debtor will be forced to part with his money. The first resolution of this kind was pre- sented to the council yesterday with an explanatory note from the treasurer, 8o far known there is no case on the local records where the authorities have attempted to collect taxes by eivil action. Treasurer Hennings, however, says that the law distinctly authorizes it as a mode of proceedure for the county treasurer, the city treasurer working under the same regulations, with the exception that he deals with the mayor and city council in- stead of the county board “I can see no reason why this method should not succeed,” said the treasurer. “As a matter of fact I think the delinquent taxes will be paid in a majority of these cases before we begin suit. It is the only | way tn which we can gather the taxes for property that has been disposed of and I intend to invoke its aid. Mortality Statistics.
