STRANGE COUNT IN SOUTH OMAHA WARD When Clerks Are Unable to Make Tally They Accept Resnlt ¥ tatte Postponed Until Tha Positive evidence of lrregularity om the part of certain election clerks and judg: was revenled at yesterday's hearing of the contest proceedings wherein John F. Schultz, Albert J. Coleson, Fred M. Youngs and Carsten Rohwer, republicans, seek to prove their right to the legislative seats for which John Liddell, Frank T. Ransom, Cary M. Hunt and Charles T. Johuson, fusioniets, hold certificates. The hearing opened at 10 o'clock in room 106, Bee bullding, before Frank J. But- cliffe and George W. Covell, notaries public. At noon adjournment was taken until next Thursday morning, on account of & part ot the counsel having business before the supreme court at Limcoln. The attorneys for the contestants are E. W. Stmeral and Willlam A. Redick, while Ed P. Smith, Willlam Gurley and L. J. Platti appear for the contestees. Although the greater part of the forenoon was consumed in prelimiraries incident to the opening, emough material evidence was brought out to indicate that the contestants are operating on a tangible basis and that developments of still greater moment aro yet to come. Clerks Take Libert Fred M. Youngs, one of the contestants, was the principal witness of the forenoon. Mr. Youngs' testimony related particularly to the count in the First precinct of the Third ward in South Omaha. In substance, Mr. Youngs sald he watched the count in tho aforesald precinct and that Re saw about two-thirds of it. He observed that frequently when the clerks could not make thelr counts tally they simply agreed upon whatever figure was most favorable to the democrats or fuslonists. Mr. Youngs could not state exactly the number of votes thus gained by the fusionists, but ap- proximately he rald the volume of such ballots was large. Mr. Youngs also rald he observed a strik- ing uniformity of ballots, that is, as to the manner in which they were marked. He was questioned at length upon this point and the gist of his testimony was to the effect that many of the ballots looked 1t they had been marked by one man. His reason for thus belleving, he explained on cross-examination, was that there was a remarkable similarity of crosees and other marks to be made by voters. He bhardly thought that a separate aggregation of in- dividuals would show such uniformity of chirography. Recount the Only Remedy. Mr. Youn, ald after he had taken notice of so much irregularity in the counting of the ballots, he demanded a recount and put his demand in writing. He thought it reasonable to presume that if such work was perpetrated in one precinct in South Omaha, the same conmditions might prevall elsewhere. en ed If he saw any re publican ballots rejected, he sald he ob- served a few such instances, but could not state how many. All attempts of the opposing counsel to tangle Mr. Youngs on cross-examination proved futile. He gave his testimony in & straightforward, convincing manner, carry- ing the conviction of truth. County Clerk Haverly brought books from his office and, as one of the formal incidents required In the proceedings, the election figures were produced as shown by the records. The figures were the same as have already been published in The Bee, and thelr introduction was simply one of the legal formalities which enter into the hearing. Other Ci dntes Testify. A. J. Coleson and Carsten Rohwer were called to the witness stand, but their testi- mony wes immaterial, the idea being simply to establish a record and lay the proper foundation for the proceedings. They will be called, however, later in the hearing, at which time they will give additional testi- mony. The attorneys for the contestees ob- jected to the filing of the contest papers as exhibits, on the ground that they do not contaln facts sufficient to bring the cases within the jurisdiction of the legis- lature, which body must make final d termination of the contes! It was agreed by the attorneys that all objections shall be recorded by the stenographers without ruling from the notaries, their power being the same as that of a notary in taking ordi- nary depositions. Mr. Schultz was the only contestaat who was not present. Numerou: witnesses will be examined and before the end is reached the contest promises to be- come spirites . MEYER INJURED IN COLLISION Two Street L Crash Together a enger on Rear Platform i, Hurled to Ground. Juliue Meyer, general agent of the Provi- dent Savings Life Assurance society of New York, with offices in The Bee building, was serlously injured at 10:456 o'clock SBunday evening as the result of a collision between two street cars at Sixteenth and Dodge streets. Mr. Meyer, who was on his way home from the Innes band concert, wi a patron of an eastbound Dodge street car and was standing on the rear platform smoking. The car was crowded. As it ap- proached the intersection of BSixteenth street the motorman slowed up and sounded the gong, as tho custom is, and then, as the coast seemed clear, turned on the power to cross the Sixteenth street tracks. Just at this moment someone shouted “Look out!'"" The gongs of two street cars clanged, and an Instant later the Dodge street car was nearly lifted from the rails, bhaving been struck near the rear ond by the head of a southbound Sixteenth street car, Mr. Meyer, who, holding to the brass rail- ing, was standing near the steps of the platform, was hurled to the pavement, where he lay unconsclous. Three other men were precipitated to the asphalt also, but managed to alight upon their feet and were unhurt. Mr. Meyer was carried into the corner drug store, where restoratives were administered, and later he was taken to his home, 1123 Farnam street, A pbysiclan who examined his injuries #ays Mr. Meyer has sustained a fractured rib and possibly internal injuries.
