The streets had 1ot been opened through the addition, B, belleving and relying on the truth of the'representations made by the agent, en- tered into a written contract with H, agree- ing to purchase and pay for said lots. The representation as to lot 1 belng a corner lot was false. Held: That these representations under the cir- cumstances were material, and entitled to_a rescission of the contract. 2. A purchaser of real estate has a right to believe and rely upon representations made to him by his vendor as to the char- acter, quality and location of the property, when' the facts concerning which the repres sentations are made are unknown to the vendee. 3. If a vendor makes material representa~ tions as to the character, quality or location of his real cstate, and the vendee bellev relies and acts on' these representations an they prove to be false, the vendor cannob shield himself from the consequences of his fraudulent conduct by ‘interposing the plea of laches on the part of his vendee. Bubsequent an instrument was executed and delivere by the mortgagee reciting the execution of the mortgage and describing it, but reciting that it conveyed the Dodge county lands, describing the same, but making no refers ence by deseription to the other land. The "Instrument then proceeded ol lows: “I do hereby acknowledge that t sald mortgage and the note accompanyin the same is redeemed, paid and satisfl and T do hereby release all my claim to the premises covered by sald mortgage, and do release and quit claim unto’ (the mort- gagors) “thelr heirs and assigns foreves the premises covered by sald mortgage, an do release all obligations dus me by virtus of said note and mortgage'" This instr ment was acknowledged, and was recorded in Dodgo county, but not in Douglas. Bub- sequently an action was brought to fores close the mortzage on the D land against one who had par the execution of the release, but without notice thereof. Held: 1. That the release extended to all land deseribed in the mortgage and was not res stricted to the particular tract described in the recital 2.
