Hiatt vs Kinkald, followed. 2. Under a general denial in replevin the defendant may show any facts tending to disprove the plaintiff’s ownership or right of possession. 3. Therefore, where the defendant an- swered by a_general denial, followed by a special pleading of facts admissible under the general denial, it was not error for the trial court in stating the issues to the jury to state the defense as consisting of a denial of the plaintiff’s claims. 4. The defense in an action of replevin being that plaintiff and defendant were partners and the property in controversy partnership propery, the burden of proot is upon the plaintiff to establish his ex- clusive right. 5. Where one partner, by a writ of re- plevin, takes partnership property from the possession of the other, the value of the latter's possession should bé assessed at the full yalue of the property, as no accounting can be had In that action to determine de- fendant’s actual interest. 6. Before the bonds were approved, however, the com- missioners were favored with some ideas upon the question of materfal to be used in the construction of the three roads. “George Redman and fifty-nine other prop- erty owners from the country fn the vieinity of the Military road petitioned the board to reject the Colorado sandstone and use macadam in its stead. This was followed by a petition signed by thirty other property owners, all of whom wanted the commis- sloners to pave the road with the sandstone. Judge Bradley, in behalf of himself and & number of the farmers from the country sur- rounding Benson, appeared before the board and urged the commissioners 'to change the materfal from stone to macadam. He urged that it the commissioners would go out among the farmers of the northwestorn portion of the county they would find that nin® out of every ten favored macadam. The stone was good enough as far as {t went, but the appropriation would lay but about two miles of pavement, while it would lay some seven miles of macadam. Mr. Bradley sald that he could not see why the board would not give the people the kind of pave- ment for which they had_ petitioned. He sald that he agreed with Commissioner Wil- liams, who only one year ago went before the farmers of the county, and at thelr meetings read a paper advocating macadam as the proper material for use In paving country roads. Since that time, he said that Mr. Williams had become a strong ad- cate of stone and proposed to give the pro- ple that material, whether they wanted it or not. There was no reason why the farmers should be punished by having a stone pave- ment when they could get one that they wanted, If macadam was not a success, the property owners and the farmers along the line of the road were willing to take the blame upon themselves and relieve the com- missioners of all_responsibility. Commissioner Williams said that If maca- dam was laid under certain conditions then he was still an advocate of macadam, but the conditions provided for in the specifica- tions were far from being such as he advo- cated in the paper read before the farmers’ meetings. B. L. Snow of Benson was before the board representing thirty property owncrs who pro- tested against macadam and petitioned in favor of stone. He said tnat he started with his petition only a short time before the convening of the board, and if he had taken a whole day he couid have secured the signatures of hundreds of farmers who would have asked for stone. In fact, sevens teen men out of every twenty, he sald, were against macadam. Robert W. Patrick, representing the ln- terests of some of the property owners along the line of the Dodge street road, protested against the use of macadam. He said that he was willing to exchange with the people to the north, giving them the macadam and in return he would take the sandstone. He did not think that the mac- adam would last six months, and in the end he was of the opinion that {t would prove a miserable failure. He thought that it would be just as well for tho commissioners to take the $50,000 and dump it Into the river as to spend it in putting macadam upon the Dodge street road. After the speeches had been dellvered, the petitions and ihe protests were placed on file and the board took up routine busi- ness. Curtis C. Turner wrote that he and Guy C. Barton would like to appear before the board at some future date for the purpose of discussing the road question. The clerk was instructed to inform the gentlemen that they could be heard next Saturday after- noon. By resolution it was decided that the $150,000, the proceeds of the improvement bonds, should be expended equally on the three roads. The committee on court house and jafl was Instructed to hire a man at $40 per month, whose dutles should be to keep the court house grounds in condition, thus doing away with the labor of county jail prisoners, who in the past have performed the yard work under the supervision of the superintendent of the bullding. A gang of laborers engaged In digging a sewer trench at Twenty-fourth and Lake strets came across a relic of early Omaha yesterday. They had reached a depth of several feet with their excavation when they ran against what they took for a large rock. They dug around it and found it to be about ten feet long and nearly half as much In breadth and depth. Further investigation showed that it was not a single stone, but was composed of a number of large rocks solldly cemented together. No one was able to surmise for what purpose the stone had been put there until one of the old residents happened along and sald that there was formerly a spring at the spot where the stone was found, When the street was lald out the rocks and cement were lald there to cover up t spring, and In that way the water had been forced to seek some other outlet. Every one had forgotten that the spring had ever existed until the discovery of the rock served as a reminder of the fact. e Remarkable Cure of Rheumatism.
