LINCOLN, May 9.—(Special to The Bee.)— All of the college societies composing the Nebraska State Oratorical association, with one exception, have adopted resolutions pro- testing against the admission of Adam Me- Mullen as the Nebraska delegate to the in- terstate contest at Indianapolis next Friday. At a mass meeting of the students of Doane college at Crete the following resolution was adopted: Resolved, That we hoartily endorse the resolutions of the students and facuity of the State university condemning the transac- tions of Adam McMullen in the local and state contests, and we protest against his ropresenting our state at the interstate ora- torical contest. The students at Cotner university in this city also held a mass meeting at which res- olutions of protest were adopted. The Cot- ner students assert that the fair name ot Nebraska schools and colleges would be tar- nished if McMullen's conduct was silently ignored. The students of the Nebraska Wesleyan University Place are holding a mass meeting this afternoon and similar resolutions are likely to be adopted. In the meantime Me- Mullen has gone to Indianapolis armed with the affidavits for his defense. His defense was not given out here and has not been made public. Hg is being backed by some of the best known men in the state, who as yet are satisfied as to his innocence. The rival fraternities started a report last evening calculated to explain away the re- puted forgery of a draft sent to McMullen by his father. An afternoon paper, the Call, stated that the draft had been sent to an- other A. McMullen and by him cashed by mistake, The statement was evidently made without any previous investigation. There is another A. McMullen in Lincoln. He is the manager of the Huber Manufacturing company at 707 O street and is one of the best known business men of Lincoln. He was not at his office today, but his clerk stated that Mr. McMullen did all of his bank- ing business at the First National and that it was not at all likely that he would make a mistake in cashing a draft which did not belong to him. Besides, he is a man 52 years old and would have some inconven- fence in impersonating a smooth-faced uni- versity student. POLICE JUDGE VINDICATED. The refusal of Mayor Weir to approve of Police Judge Waters' official bond upon the occasion of his re-clection last month, for the reason that the judge's accounts were not in regular form, is still remembered by the readers of this paper in Lincoln. For many weeks rumors had been in circulation to the effect that the judge was short In his accounts and that he had not turned uver to the city treasurer all the fines he had collected, ete. At the request of Judge Waters, the city attorney was authorized to commence an investigation. The investiga- tion has been completed, and the city at- torney reports that Judge Waters not only turned over to the city treasurer every cent due the city, but had actually paid over several dollars more than the city was en- titled to. The report shows that the total fines collected belonging to the county amounted to $631.60, and that the amount paid to the county treasurer by Judge Waters was $631.30, leaving an apparent shortage of 30 cents. The amount of fines due the city was $8,146.40, and the amount turned over, $8,442.75, leaving an apparent shortage of $3.65. But in the account Judge Waters is charged with a $10 fine assessed against N. H. Vincent, while the record at the police court shows that Vincent's fine was remitted by Acting Mayor Graham. So the city is indebted to Judge Waters to the amount of $6.35. ' GOSSIP AT THE STATE HOUSE. Governor Crounse went to Schuyler teday to attend a Grand Army of the Republic meeting. The adjutant general and other members of his staff, accompanied him and they will receive a reception at Schuyler by the local company of the Nebraska National guards, Secretary W. A. Dilworth of the State Board of Transportation went to Kenesaw last evening to investigate a complaint of local merchants who desire a strect crossing put in over the B. & M. tracks in that town. There is one more thing to explain about the tabulated statement of railroad assess- ments made up by the State Board of Equali- zation. The assessment of telegraph lines does not_include the lines along the line of the B. & M. railrond company. That company owns its own telegraph system and its line is included in the assessment of the railroad. The case of Steele against Ashenfelter, from Gage county, is the first case to be submitted under the following provision of rule 3 of the supreme court: “Any cause may be submitted upon a written stipulation of ‘the parties thereto providing for such submission on printed briefs accompanied by or containing an agreed printed abstract of all the evidence upon which the case Is to be determined.” It is quite probable that advantage will be taken of this rule frequently in the future, as thercby parties are enabled to have their cases submitted much earlier than would otherwise be the case.
