It is highly improbatle then that Webber was one of these tiwo men, and that though discovered he the fool- hardiness to venture back again. But the conclusion that Webber was not one of the o men discovercd by the police and that he was ignorant of their attempt and their discovery does notovercome the presumption that there was some connectinz link between all three of thescattempts. The material used in all three atte vas such as dina ily found only in engine houses, machine | shovs and the 1i he differont paftics within a short time attempted to commiv the same crime at the same place and in the same manner. The two men who weve dis- coveved ran to the Broadway engine house and Webber, who was very indisereetly re leased when first caught.” was rear the same night in the sanie er company with his co-defendant, Nichols These facts would show that the partics who made these three attempts were all « ing in futherance of a prearranged conspi acy and that tho rendezvous of the conspir- ators was the Brondway ongine house, De- feudants Nickolson and Schofield were both firemen who are stationed at this enzine house. October 11, the day the conspiracy Is said to have been formed, they were with Webber in suloons and other places in Omalh, Wolght of Webber's Testinon ine housc «eaving out of consideration confession the other eviacnce is sufiicient to show that there was a conspi , and to fasten the guilt on Webber, Nicholfon and Sehofield. Webber testified that he was not present at the first two attempts to fire tho build- ing, being cogaged ut the time in playing poker m Hausen's saloon; that he was a that when ho oon he went directly to the en- s house, secured the waste saturated with oil and without any conversaticn with any one went alone to the place where he was caught. ‘This testimony was shown to e frue by other facts in evidence. “*Webber further testified that on the after- noon of October 11 he ana Chief Nicholson and Schofield were together in Omaha, and that while returnivg on the car they talked about the tive department of Omahu as com- pered with Council Bluffs, and Chief Nichol- sou suid that 1f we had more fires we would Dave more men,' und that it Webber would got & ‘hustle’ he could get n job, and that we would set three or four fire wore men.” Nicholson also said, *You get out and rustle nml do the job, and you will got on the fo “Webber further testified that Nicholson promised to kivk for more men, and us Web- her had been a substitute and was trying to geton regular, Schofield and he azreed to start a fire. The two buildis talked of were the ones which were fived, and one back of Maurer's china store,” Vebber's party 1o the conspiracy, and lery Conspiragy Cloarly Shown, ho judge after quoting the statutory re- quirement that the evidence of an accomplice should be corroborated, quated authority showing that this corroboration might be by circumstantisl evidence just us surely us by thesoral testimony of some witness. “Tho court held that Webber's testimony was clearly corroborated as to the fuct that te had confederates, and that ho was not present at the first two attempts to burn the building. and was ignorant of them when he weny to the building for that purpose, and that he had made the attompt in pursuance of a prior conspiracy. Theso material points He was further corroborated in his testi mony that Nichoison and Schofield were the co-conspirators by the fact that the rendez- vous of the parties to the crime was the eneine house where they are stationed, and that at the time and place where he testifies the conspiracy was formed he and these de- fendanuts were togetner in « ha. What th On the part of the defense the.only wit nesses wore Nicholson and Schofield, who admitted thut they were with Webber in Omaha and had_several beers together, got onto the same aud returned together then going into the Denver saloon, where thoy had “nother dvink together, They de- nied having had such a conversation as Web- ber nareated, and denied that thoy had an, any conversation at all. ‘The only remark made, according to their testimony, was one uttered by Nicholson, who simply saia there was a strony wind blowing, bug 1o one made reply and nothing more wus said during the whole ride home. That compawdons thus drinking together should ride so far to- gether without any conversation wus highly iwprobable. and ‘was, to the mind of the court, highly damaging to the defendauts De‘ense Olfered, It Csuggested «to the judicial miod that some such conversation us Webber narrated actually occurred, and that Nicholson and Schofield, deny ing the conversation, feared to venture upon the fabrication of auother conversation, lest they might be involved In contradictions and their falsehoods thus bo proclaimed By a denial that thoy had auy conversation Latever during the considerable period of their ride or the car, they could easily be consistent in their testimony, All the Firemen Councerned. No deninl is nade by the occupants of the house that any of their number were out at that time of night and recurned as testified to by the police. The counsel for the defense had com mented upon the fact that the officers did not follow up these two men who entered the engine house, and arrest them. What ever lnck of judgment they may have shown or whatever motivs may have controlled them, it was only pertinent to consider their conduct as_bearing upon the weight of evidence to be given their testimony. He stated that in_ view of the action of Judge McGee in biudiug Nicholson over to the grand jury and the public senti- ment that has been stivred up against Nich- olson, he shouid advise the latter to request asuspension. His reason for this was that Nicholson would not be able to bring in evi dence enough to clear himself in the eyes of the public under the present state of affairs, and it would be unjust to compel him to sub- mit to an investigation. After some d cussion it was decided to compiy with his r quest. The question of his successor was then taken up, and it was decided to appoint James G. Bradley, the present _electrician, to the posicion of acting chief during Nich- olson’s temporary suspension, His salary is to be $105 per month, and he is to act as both chief and electrician, Made an sna of Schotield, On motion of Jennings the chief was in- structed to discharge Fireman Miles Scho- fleld. The motion was carricd unanumously, and that is right where the council fell into its trap and showed the true animus of 1its proceedings against Nicholson. Alderman Smith called attention to the tact that there was 1o difference in the charges against Nicholson and Schofield, and yet the council had discharged the latter and only sus- pended the former. The injustice of this was at once apparent, and Jjennings amended his motfon 50 as to suspend Schofield also. This motion was carried. The action of the council is gencrally re- garded as a very neat schemo of the demo- cratic side of tne house to let the chief down as easily as possible. If the grand jury indicts him his careor as fire chief will likely he at an end. 1f not, it will then vest with the council to say whether he shall have an_investigation or not. It is hoped that by the middle of November when the next session of the grand jury will probably have boen completed, the feeli against Nicholson will nave so' far subsided that he can be reinstated without ado. Smith was the only alderman whohaa a word to say against the scheme, oven Tib- bitts, the other republican, siding with the democrats, City Attorne¢ Hazelton was called upon for advice while the discussion was in pro- gress. He told the council that the charge whichi it was called upon to 1nvestivate was entirely distinct from that placed in the hanas of the grand jury, and should nov be allowed to depend on the lutter.
