H, Irvine, who ou the 26th of last May shotand killed Banker Montgomery 1n the dining room of the Hotel Lincoln, ro- colved a telegram last night from Mation, Ind., conveving tho intelligence that his father was dead. Mr. Irvine, sr., was taken suddenly i1l on receipt of the news from Lin- coln concerning the terrible tragedy Iin which his son was a contral figure and although he apparently recovered has bpen in doclining health, The intolligoncs was a terrible blow to the sou and for over an hour he cried like a child, the fact that he could not be presont to pay tis last tribute adding poignancy to his grief. Although the prisoner’s general health since confinemont has boen fair, he has gradually wasted physically and 1s far from being the man he was before the killing, his face eepecially showing the effects of tho terriblo mental strain he has undergone. His trial is set for soven weoks from today. Heard In the Courtroom Judee Cooloy was in town today, and un- burdened bimself of a vory voluminous an- swer in a case in county court where his fathor, G, S, Cooley,bud brought suit against his sister, Marion (. Keefer, claiming thav she had entored into & conspiracy with her Jhusband to defraud him of some land in Cass ‘county. A specific denial of each charge is made, and rs. Keefer shows by an ab- solule deed from the grantor, Payno, that the property was not sold her in trust for her father, as ho alleged.
