SAVED THE SCHOOL LANDS Commissicner Humphrey's Work Worth Thousands to Nebraska, INTERPRETATION OF THE LAW HIS Tndientions That it 1s Safficlently Correct to Cause the Department to Consider he Subject Fully—Other Line coln News Notes. Lixcory, Neb,, April 22.—[Special to Tare Ber.]—-Ono of the frincipal errands of State Land Commissioner Humphrey on his recent visit to the national cupital was to consult with tho officials of the genoral land ofice 1n regard to the selection of indemnity lands to take tho place of school sections 16 and 56 in the Ponca Indian reservation, recently thrown open to settiement, Theso sections were not exempted from homestead cntry when the reservation was thrown open to settlement as the law exprossly stated that thoy wero not resorved for school pur posos. Tho school sections in Boya county outside of the Ponca reservation, however, are not open to homestead entry, according to Commissioner Humphrey's in- torpretation of the Jaw, and he is endeavor ing to convince the land ¢epartmenttl ut his view of tho case is the correct one. The land officials at the O'Neiil land oftice have been permitting homestead entries on these sections and desisted only when the emphatic protests of Commissioner Hum phirey reached the department at Washing- ton. For tho present ai least these sec- tions will not be entered. Commissioner Humphrey is backed in hiis position by a let- ter received from ex-Commissioner (3-off, written while that gentleman was still (n of- fice, in which it is stated that while sections 16 and 36 in the Pouca reservation are not exempt from homestead entry, the corre. sponding sections in Boyd county, cutside of the Ponca rescrvation, are expressly reserved for tho state of Nebraska for school pur- poses. The present cominissioner of the general land office is investigating the mat- ter at the request of Commissioner Hum- phrey and thero are good rewsons for believ- ne that bo will coufirm the opinion of ex- Commssioner Groff. The prompt und cner- getic measures taken by Commissioner Hum- phrey will savo to tho state of Nebraska a good wany thousand acres of school lands which would have been lost had he sat gui- otly by nd made no protest. Concerning the Warehouse Law, “A popular otror exists in regard to tho workings of the new warebouse law, espec- fally with reforence to tho grain inspection and weighing departments,” said . member of the Stato Board of Transportation this morning. *“Tho chief erain inspector and weighmastor are paid from the fees they col- lect. They have no statod salary beyond tho fact that 1f the fees collected amount to a suflicient sum each month the chiofs of cach department may reserve the sum of $166 for his salary. If the fecs amount to a less sum tuo loss falls upon toe ofti- cial and not upon thestate, The grain depart- et is cxactly upon tho samo basis with referenco to tho state treasury as tho oil in- spection department. It must, sustain itself. Tko law fixes the maximum of fees that may be rotainod as salaries in cach department. Auy excess of feos collected must bo turned 1010 tho stato treasury. Any doficiency will not be made up from the state, but must fall upon the ofticials. Tho oil inspection law has been in force since 1885, There haye been months when the fees did not pay exponses ; and yet never in a singlo instance has tho state been asked to make up tho deficiency. On the contrary, there have bocn years in which the oil ‘inspection depurtment has turned a considerable sum into the treasury. t cannot be denied that when the law first went into operation tho several depart- ments wero organized upon ascalo eutirely too maguificent, Al this, however, has been changed. The inspection department 1s now run at third of tho former cxpenso, The State Board of Transportetion has empha- sized tho fact all along that tho chicfs of tho departments cannot hopo to bo_ remunerated for the deiiciency in the amount of fees col- Jected during the first year of tho operation of the luw. 1f they asi tho coming logisla- turo for a deficiency appropriation they will do s0 upon their own responsibility and against the protests of the board. Thero is not a singlo member of tho board who will voto to recommend a deficiency appropriu- tion,” Mrs. Sheedy in Court Again. The Sheody estate is 1n court again aftgr a disnppoaranco of several months. C.” O. Whedon, Mrs. Sheedy’s attorney, recontly called upon Administrator Aiken for the monthly allowance, which had been awarded 10 Mrs. Sheedy from the estate of tho late John Sheedy. “Whedon represented that the allowance began on February 12, and there- upon Aiken paid over tho monoy. Later, however, Aiken discovered that the first year's allowance, which haa s drawn in bulk, carried Mrs. Sheedy apto March 10, Consequently when Mr. Whedon appeared to collect anothier montn’s allowanco ho was met with a vefusal, the administrator claim- ing that the allowance had boca paid up to April 19, Mr. Whedon threatens to have tho admivistrator arrested for contomvt of court, And now the attorney for tho broth- ers and sisters of tho deceased come into court nud asks that the order granting Mus, Bheedy sn annual allowanco bo set aside, Martin's Death Unavoldable, The inquest over tho body of Joseph Mar- tin, who was killed by a Union Pacitic train last ‘l'uesday night, was held this forenoon. The testimony showed that Martin was an old man partiailly deaf; that ho was seen to step out from behind a shanty near the truck on the abroach of the train and that when the locomotive was within about ten feet of him he walked directly in front of it and was thrown under the "wheels, Tho jury found a verdict to the effect that Martin came to his death by being struck by a train, but exonerating the railvoad compiany from all blame iu the premises, 0dds and Ends, H.
