CANNOT SIGN THE CONTRACT, Magor Oushing Eajoined from Approving the Oonncil's Furniture Contract. CENTRAL LABOR UN:0N ASKS THE ORDER. Represeutative Workmen Demand- ing Fair Play for Omaha Face tories—Judge Estelle Declares Coal Licenses Hlegal Tuesday night there were fourteon members who attended the council meeting. Of this number a majority decided to accept the bid of the Ketcham Furniture company, $24,- 721,50, for supplying the new city hall with farnituve. ‘The contract was ordered to be sent to the mayor for his approval, Should it reach ths executive in due time, as 1t undoubtedly will, it will be several days before the officiar autograph can be attached as the courts have stepped 1n and instructed the mayor to stay his band. Tywo weeks ago at a meeting of the Central Labor union, which was attended by repre- sentatives from every labor organization in the city, the furniture doal was discussed in all of 1its phoses. But one opinion revafied, and that was that tho Kotcham Furniture company, through its agents, had been guilty of lllnmp'lnglo bribe councilmen to vote for its contract. The members reviewed the case and the acts of all of tho parties con- nected, from the time that the bids were submitted until the close of the boodle inves- tigation. By a unanimous vote it was decided to ap- peal to tho courts for velief. ‘The members ointed to tho fact that the council had re- rc("ud the bid of the lowest bidder, bad slapped & home industry in the face and nad acted In such’ a maunner as o arouse suspicion even 1l none of the members were guilty of accepting bribes from the Ketcham Furniture company or its agency. The matter was turned over to the emer- gency committee, and its chairman, Julius Meyer, instructed to watch tho case and take the necessary legal stops to prevent the award of the contract to the Ketcham peo- ple. ¥ Gaot the Injunction. Yesterday morning, as soon as Mr. Meyer bad learned of the action of the coun- cil, he at once proceeded to tho of- fico of Attorney E. W, Simeral and Iaid the case before lam. An hour later Mr. Simeral appeared before Judge Hopewell who issued a restraining order, enjoining the city, the mayor or any of 1ts agents from ap- proving or entering into any contract with the Kotcham Furniture company. Judge Hopewell set the case for hearing on De- cember 23, at 2 o’clock in the afternoon. ''he bond was fixed in the sum of §500, executed by Thomas Swobe. The petition filed by Mr. Simeral reviews the case nnd then sets out some interesting facts. It shows that the city council set asido for city hull purposes the sum of & 500.00, of which amount $367,109.47 has ready been contracted for or expenaed, mak- ing an overdraft on the fund of $0,609.41. This, the petition alleges, 1s contrary to law, as the statuies specifically provide that no contract shall be let or moncy expened unless the comptroller shall reissue his certificate thue there are fuuds on hand with which to make the payments, ‘The petition also sets forth the fact that tho cham Furniture company’s bid was 50, whilo that of John I, Coots was , and that the contract was not let to the lowest bidder. The intercsting feature of the petition is tho section or paragraph that charges that the Ketcham Furniture company procured its contract through fraud aud oy brib- ing members of ~ the common council. ‘Then the petition alleges that the price which the Kotcham company proposes to charge for furniture is excessive and unreasonable, and that the amount proposed to bo furnisned is In excess of the demunds of the city. Lastly the petition declares that, knowing all of these facts, in voting to award the con- tract the council went beyond its authority and the members willfully abused the trust imposed upon them by the voters and taxpay- ers of the city of Omaha, REASONS FOR 1HE INJUNCTION. Central Labor Union Men Explain ‘That Organization’s Action. Harry Eastman, president of the Central Labor union, said: ‘“I'his mutter was brought to our attention somo time ago and wo referred it to the touncil, bnt we could get them to #0 nvothing in the premises. It was then proposed that we should get one of our members, a citizen and freeholder and have him ootaiu an injunction against the letting of the furniture contract to the Ketcham company. But then, you know, we did not want one of our men to get the worst of 1t in caso there should be any trouble because we are not lawyers and are nearly all poor men. So we saw a lawyer and another person and they said there would be no responsibility upon the man who might ask the injunc- tion, It would be all right. Well,T went away next day and have beéen away about three weeks, L expected the injunction would be Rgotten out before this because one of our members said he would get it out if he was protected. “Now, I tell you, the council did not do right. If there had been several bidders and all the Omaha men were higher tho council should have let the contract to the Lome factory. You know that tends to improve the city. Where work of this kind is done in one_lire it indirectly helps every other ine. Wo took the stand that we wanted to help our brothers who are woodworkers, We did this because we waut all the trades to help one another and because we are roally in favor of having all this work dono by day's labor, whether it be grading, paving,curbing, guttoring or furnish- fug city or public institutions of all kinds, If tho charter is not 5o situatea as to enablo this to be done, it ought to be changed; not because the contract ought to have gone to Coots or Dewey & Stone, but simply because the money would have to be handled here and would buve done us some good. ““When we went to the council they treatod us shubbily, They aid not uct as our repre- sentatives. I ao not mean boycott exactly, but we will gradu ally drift away from patronizing those who do not patronize the manufacturers for whom our tradesmen work. *‘Now, if this contract had been let for ex- ample to Coots, bis factory could have been running open, glving employment to a large number of men. As it is, 1t may have to be shut down for the winter, This would not be a benefit solely to the wood workers, but also to the painters ana finishers and other workers.” Coal Licenses I legal, ‘'he courts bave held that the city or- dinance compelling coal dealers to pay an an- nual license of §100 each before engaging in tho business of selling coal at retail is illogal and void.
