MeMaton himself was put upon the stand vesterday morning immediately after court convened and was put through a searching cross-examination by County Attorne, Organ, He admitted securing the loans Latham, accoraing to tho st uts of the old man‘and his wife, Had secured a loan of #1000 to pay off the previous one of 00, but had failed to apply the $1,000 to the pur- pose for which it was intended. Ho said ther wero Jjudgments against Latham's laud which Nad been unsettled but could ot say just what they were. He also admitted negotiating the loan of £1,600, which was intonded by Latham 1o go tow- ard settling up the previous loan of $1,000 and that of £500. He claimed he used a part of iy to pay off the £00 loan and gave tho I 0 Lat m, with the understanding that Latham was 'to use it in paying off the &1,000loan. Ho did not act as agent for Latham, but for eastern parties who held the mortgages on Latham’s property. He stated that he bad never had any con- vorsation with cither Latham or his wife after they signed tho mortgage for £1,600, and be denied point blank ever having told the that he would pay the: the money if th would agree not to make him trovble, as both Mr. ana Mrs. Latham had stated on tho stand. His eross-cxamination was unsatis- factory to the county nttorney and the wit- ness, as well on account of the lack of merory he displayed in regard to a number of very important points in the ease, Mrs, Mediahon, the mother of tho defend- ant, who has sat by his side all through the trial, was put on'the stand, and testified that when her son left the city in October, 1856, ho loft a lot of his valuabie papers with her, and that in going through them one day she'eame across a receipt bearing the signa- ture of Edmund Latham in full settlement of all claims Latham might have upon tho defendant up to date. Sho took the receipt to George I, Wright, who had acted as torney for her son and it was locked up by him in his safe. On_cross-examination sho admitted that she had not noticed the date of the instrument and_coula not say whether it bad been mage out before or after the loan of £1,600 was made, Wright testified to having seen receipt, but his mind was_even more cloudy on the subjact than that of Mrs. MecMahon.~ He could not tell the date of tho instrument uor the amount for which it was issued, and ho could not swear to a cortainty the signature appended to it that of Kdmund Latham, as he nad ot seen his signatare more than once or twice before. ‘T'he receipt itse!f had been locked up in his safe with such 4 vengeance that it had never veen secn from. that day to this and all efforts to find it tiad been fruitless. He was quite sure, how- ever, that it was still in his oftice. Mrs, Latham was recalled and questioned as to the conversations she claimed to have had with McMabon and which Mc hon de- nied had ever taken place. She told of three different times when McMahon bad told her ho would pay the money if sho would nov malce him any trouble, On bemg recalled Mr. Latham also con- tradicted McMahon's testimony by stating that MeMahon had always paid the interest on the £00 loan, and that he had never seen a cent of the $1,000. A. T. Flickinger, who bad acted as atiorney for the plaintiff in tho suit which was brought to foreclose on the £00 loan, corroborated Latham’s statemont with reference to the payment of interest by MeMahon during the two y mortgago in bis possession In the afternoon Attorney Baldw dressed the jury on behalf ‘of his client for about an hour, during ali of which time ho was listened to by the jury and the audienco with the closest attention. County Attornoy Orean followed with a concise state his side of the case, answering each point brought forward by ' his opponent, and the caso went to the jury at+4:30 o'clock.
