A petition has been filed in the district court to have the proceedings in the estate of the late J. M. Phillips reviewed and the approval of Administrator Askwith’s bond and the fixing of his compensation sot aside. The piaintiffs in the case are N. C. Phillips, J. N. Phillips, Gron- ville D. Phitlips, Mary'O. Phillips, Ruth M. Shepherd and Emma Voswinkle, all of them heirs of the Phillips estate. A.'W. Askwith was appointed administrator and a short time ago his compensation was fixed at §1,500, to- gether with other special fees for special services which he claimed to have rendered. ‘The heirs now claim that he has not done labor in connection with the caso that war- rauts the granting of such u fee. ‘Many of the services for which Asicwith claimed com- pensation, it is alleged were performed by other parties, some of whom were members of the family. Some of the settlements which he claimed to have made with the creditors of the deceased were paid for by other parties, and now Ask- with wants a double fee. According to it there have been but nineteen deaths during the entire month, fiftecn of which were females and four males Of the nineteen all but six were less than a year old.
