Jounty Commissioners F preme Court Decisi County Commissionor Timme is a happy man—happy becauso he has won his snit in the supreme court. Timmo is not alone in his joy, as Chaivman O'Keeffo and ex-County Commissioner W. J. Mouut are in the same mood and for tho same reason. Tho case is one of long standing. Prior to 1880 the county commissioners were paid 3 por day and mileage. In 1887 the lowislaturo enacted n law providing for $ por day. The law was passed in January and went futo effect in July. ‘The commissioners claimed that undor the new luw they were entitled to the $ per diem, but the county attorney could not seo it in that light. 'limme, who had been in oftice but six months, confered with tho other members of tne board and decided to sue the county for the extra 2 per day that had accu- mulafod since ho had taken his seat. Tho county attorney held that a law could not be passed to raiso n man's sa'*vv while he held the office. T'ho case « as triel n the district court and Timme won, . 1.+ w ch the county appealed to the supreme court. ‘I L@ decision handed down yesterday aftirms the decision of tha lower court and places $162 1 Mr. Timme's pocket. O'Keeffo, who had served nearly a year after the new law went into effect, will get 3600 and W. J. Mount will te JUST T J fit by a Su- richor by nearly §1,000.
