He pleaded guilty before Judge McGee and was sentenced to pay fine of #4.60, in dofault of which he was sent tothe county jail to board the amount out with Sheriff O'Neill. It has long been a question whether the city ordinance authorizing pro- ceedings of that kind leeal, and Dilsaver consulted Attorneys Dailey and Avlesworth as 1o the steps that shoula be taken, Yester- day afternoon the matt me to a head, and @ writ of haveas corpus was sued out in dis- trict court for the release of Dilsaver. The ground upon which the writ is asked tor is the illegality of the ordinance. ‘The attorneys claim that the city has no right to puni:h offenses of any kind except in so far as that right is given it by the statutes of the state, They further claim that there is no such thing ns a disorderly house men- tioned 1n the statutes, so that no 'aw relating to the subject can bo passed by the city. The question will bo heard before either Judge Smith or Judge Deerer_this morning at 9 o'clock, aud the mattor will be decided. Tho city ordiuance above referred to is to be triod 1o its utmost capacity in the next few months. Captain W. A. Bert Evans, Mike Kildare and Charles vans had an_experience at Lake Manawa yesterday morning that will last them the rest of the season. They wera crossing the luke while a stiff breeze was blowing. They attempted to tack, when the rudder suddenly broke. The weikht of the boat had been throwa upon the rudder, and the giving way of the support capsized the boat and sent the threo occupants nto the water houd first. ‘They were near the south beach when the accident ocenrred, and they at first thought they would be able to swim to the shore without much trouble, but the wind was from the south and a short trial convinced them that it would be flying in tne face of providence for them to try to swim in that direction, and they turned about ana struck out for the north shore. A young man named Thomas, who tends the boats saw their pre- dicament and st out iu a row boat to help them. After ho had nearly reached the three swimmers, he too ran against the wind and capsized. 'He was so uear the others, how- ever, that they wero able to reach the boat and climb on top, and in this way_the luck- less quartet driited in to shore.
