The city ordinance which giv of police court power to imposo a fine on the of disorde houses is to be given whirl this morning 1n district court linm Dilsaver was arrested about a k ngo, charged with the maintamning of u disorderly house. He pleaded guilty before Judge McGee and was sentenced to pay o fine of #4.60, in default of which he was sent tothe county jail to board the amount out with Sheriff O'Nelll. It has long been a question cr the city ordinance authorizing pro- ceedings of that kind is leeal, an consulted Attorneys Dailey Aslesworth as to the stops that should be taken. day afte the matter came to a head, and a writ of habe rpus was sued out in dis- trict court for the release of Dilsaver. The ground upon which tho writ is asked illegality of the ordinanco. ‘T'he 1m that the city has no right to puni<h oftenses of any kind except in so far us that right is given it by the statutes of the state, They further claim that there is no such thing as a disorderly house men- tioned 1n the statutes, so that no law relating to tho subject can bo passed by the city. The question will bo heard before either Judge Smith or Judge Deemer this morning at Y o'clock. aud the matter will be decided. The city ordinance above roferred to is to be tried to its utmost capacity in the next few months, Captain W. A. Hays was arrested several days ago on the charge of keeping a disordecly” house, und he was fined #+4.10 night before last at u session of the police court held for the special purpose of hearing his case. Ho atonce gave notice that the case would be appealed to the district court. He has rotained the legal services of Georze H. Hewitt, and_the case will be pushea to the furthest limit. The outcome of the cases will be watched with great_interest, from the fact that when Attorney P. E. Sea: brook left the city the saloonkeepers aud a pood share of the busiuess men of the city lay back and congratulated them- selves that they would not be troubled any more by such proceedings. The fiue system hus becn in vogue in all the priscipal cities of the state ever since the passing of the pronibitory law, but the question of its legality is one whici has never been decided by the supremo court. Whichever way the case is decided this morning, it will bo_ap- pealed to the supreme court, aud thus a vast amount of litigation is likely to result feom the opening upof the subject. s the judge 100} tor is th attorneys cf th are promptly relieved by a Saline, bottled at Excelsior and dry drink of Sulpho-§ nugs, Mo. BLurrs, Ia., June To the kd- itor of Tue BEs: It has ulways been some- thing of a mystery to me that the local news- papers, usually so prompt to praise and boom all local institutions, should overlook one of the greitest enterprises, not only in Council Bluffs, but in the entire west, when writing up the important improvements and enter- prises of the city. I refer to the United States Musonic Benevolent as- sociation. It hus only been in Tuk Bre that 1 have scen anything of late about. this pros- perous coucert. Columns have been written about the mugnificent six and seven story Elocks, the motor iines, the ks, bridges Chautauqua, Manaws and scores of othel things that command more thun local atten- tion, but very little has been said iu the local upers about this the largest and vest known Masonic fusurance society in the world. We must asure an enterprise by the extent aud character of the busiuess transucted and the amount of moneytreceived and paid out. By this measuro ull the other enterprises in the city dwindle into perhaps aot iusignifi- cance, but into small proportions compared with ' the immense volume of busincss transacted by this association. Out- side of the members of the order and the many beneficaries in the city and_vicinity there are few peaple who realize that wo have got right here in our midst one of tho greatest concerns of its kind in the world, but if they would pause as they rush by that beehive of Imlu\(,r\' the Masol temple, they could hear from the stroet the incessant ciicking of the fiying keys of type writers, the rush ana_clatter of messenger boys and clerks, and if they would nass just about the timo the mail is gathered up for any of the traius thoy would sco the po ul rks como to tho big box at the lower i of the shute that leads from the g room and gather up the lotters, not inga common delivery mail bug, but in & big enment mail sack, If they would ask tho two postal clerks who carry away the big sack about the number of letters daily taken from this siugle mail box they would learn that us Ligh as 4,000 are often” deposit od by the Masonic people in a single day. 1f this would uot give them a sufiicient idea of the vast volume of business traunsacte o visit to the various departmeuts where the ¥ lady and geutlemen clerks are the Dictures of concentrated euergy, und a two- minutes chat with Secretary W, ameson, who is & steaw. en ne of en hilmeelf, would force the conclusion tuut there is no other building in this part of the country whose walls surround a busier phalanx, or witness the pouriug in and out of such a tide of business. The unprecodonted suceess of the associa- tion is due first and primarily to the plan upon which it is orxanized, furmishing life indemuity to Masonic brethren and their families at the lowest cost consistent with strict business principles, with a gua fund from euch member thut gives a 1 cial standing and confidence that cannot be shuken, This guaranty fund has reached the immenso sum of §130,000, and continues to grow with tho same marvelous rapidity of the compuny itseif. The int st on this fund wili pay this ysar four of the reguiar death ussessments.” The company since it has been organized has paid out from its Council Bluffs ofice and through the Couucil — Bluffs banks, over #0000 to the widows and orphans of deceased Musous. he association makes a liberal contract with 1, free f annoying restrictions. It does hot pur to give its members something for nothing, but guarantees to give each the worth of his mouey, and to pay in full suca benefits the assured s entitled to under the terws of his certificatos, 1n answer tothe demands of its patrons the association is issuing a 81,250 certificato upon proportiouate rates of larger certificates. This is for the benefit of patrons who do not desiro to carry the regular 2,500 cortificates, which was formerly the smallest issued. It also cuables thg many whose confidence iu THE OMAHA “DAIL the association, which was rock-rooted from the first and has been growing every day, to the limit of 0. The more I look into the plan of this maguifi cent institution the better 1 am pleased with it, and the prouder 1 become of the fact that it is a Council Blufls institu- tion, organized by Council Bluffs men and brought to its present wonderful stugo of de- | velopment oy Council Bluffs brains and en- | ergy ! Tho hiead of the association is Judge J. R Reed, who has just boen appointed chiof jus- tice of the Ut States court of private land claims, than whom there is not a man in the country' with a cleaner record for honor .wl probity. All the other officers are gen- nen of equal integrity and high chal ter., W0, Wi, i vice president and manager of the western department, is a gentieman whose ability as an insurance 'man cannot bo ques tioned. Frod H. Brown, second vice prosi- den nd manager of the eamern department with headquarters in Chicago, has an unsul- lied business record and the experience of twenty years s an Insurance manager. There Is not a better known an in ( u\nu‘ll Bluffs than Secretary aud Treasurer W. J. Jameson and it is largely to his fertile brain and steam-pressure energy that the marvel- ous success of the association is to be at tributed. He is the working mem bor of the association and gets through with an avalanche routine business every day that would lyze an orainarily constituted individual. He pulls off his coat and rolls up his sleove when he comes into the office in the morning, but this is the ouly departure from his dray ing room munners, Meet him when you will aud he hus a crushing grasp for your hand and a cheery smile that adds days to your life and makes you feel that there is some- thing more than words in the brotherbood of man, Dr. T. There is not o man connected with the association who has not an unsullied rep- utation, and whose life has not compelled perfect confidence of all who know him. 1t is an institution that I am proud of, both as a citizen of Council Bluffs and as a Mason, confident that it is protecting my wifo and babies better than auy other agency can. They were crossing the lake while a stiff breeze was blowing, The attempted to tack, when tho rudder suddenly broke. The weikht of the boat had been throwa upon the rudder, and the giving way of the support capsized the boat and sent tho three occupants nto the water head first, ‘They were near the south beach when the accident occnrred, and they at first thought they would be able to swim to the shore without much trouble, but the wind was from the south and a short trial convinced them that it would be flying in the face of providence for them to try to swim in that direction, and they turned about ana struck out for the north shore. A young man named Thomas, who tends the boits saw their pro- dicament and set out iu u row boat to help them. Aftor ho had nearly reached the threo swimmers, ho too ran against the wind and capsized. Five or six professional-looking gentlemen with patriarchal beards drove up to the Pax- ton about 10 o'clock yesterday morning. After fighting shy of questions for some time, the gontleman who posed s the loader vouch- safed the information that they were dele. gated to the continental congress of medi- cine and surgery being held here at present W hen asked for a list of the delogates he re- plied that he was unable to_furnish it, and knew of no one who could. None of his com- panions would tell what was the object of the meeting, by whom called, nor would they answer any other pertinent questions. Iarly in” the present month a conforence was held in this city by a lot of doctors, who have been tubooed by ‘regular’ pi titioners. This conference decided to call meeting of its fellows in order to organize some kind of an association for self-protec tion. Circulors replete with rhetoric were scattered over the country by the executive committee, residiug in Omaba. 'The circular requests all non-regular practitioners to gather nere on June 22 and 23 for the pur- poso of *perfecting an_organization for the higher olovation of medical, furgical and scientific attainments; for the promotion of a more thorough mutual 1t OUrse among liberal physicians ana vecialists; to secure fair and ey, logls lation, and advance the just claim of thoso who practice medicine and the dif- ferent specialtics of medicine and surgery in the estimation of the better ciass of the peo- ple and the law."
