Commencing with the 1st of November a new demurrage rule will go into effect on all railroads running into Council Bluffs, by which, if cars arc not unloaded within tiven- ty-four hours after arrival, the consignees ‘will be charged $1 per day for all the time consumed over that time, This, it is expect- ed, will work a hurdship'to coal dealers and others who frequently hive a number of cars arrive on the sume day. g The case of the city against several hack- drivers for failing to'get a hcense for their vehicles wus aired in superior court, and taken under advisement. T'ho hackmen say they are woing to defend their position with all their might. Jonn Strayer went out to collect a bill of Daniel Carter Wednesday night and took a stonc in his pocket as an extra inducement for tho debtor to settle. He met with some opposition, however, and decided to use the weapon. ' He found Carter right with him, and also found Carter’s foot deposited upon that part of bis anatomy where 1t would do tho most good. The difficulty finaliy ended by Carter’s swearing out a warrant before Justice Barnett charging Strayer with in- tent to commit great bodily injury, An injunction suit has been commenced in the district court by J. An alarm of firo from box 42 yesterday afternoon was occasioned by a blaze whic wiped out a small barn on Seventeenth strect, between Fourth and Fifth avenues, It was over a mile from the nearcst firo house, so that the building was nearly de- stroycd when the department arrived, al- though a lard run was made. The comple- tion and equipment of the new house now in course of erection at Twenty-first and Broad- way will give this part of the city the pro- tection which its rapid growth has for some time demanded. Bus. college, Council Bluffs, Attempted Shortly before 10 o'clock last evening a still alarm called the department to the Stella Long bagnio, No. 151 Broadway. Oil nad been thrown upou tho corner of the building, near an outside stairway, and the weather boarding was well ignitea when discovered. A bottle, which had contained the inflammable fluid, was found uear by, and taken possession of by Officer Beswick, Tho firo was extnguished, and tho loss was merely nominal. It was supposed that the fire was completely extinguished when the firemen left, but at 11 o'clock an alarm from box 23 called the de- partment to the place again. Tne fire had worked under the boarding, smouldered for some time and again broken out. It was again gotten under control and the burning cmbers taken out. The proprietress is of the opinion that one of the former inmates of the place, who was turned out yesterday, at- tempted to burn the house out of revenge, as 1t was unquestionably the work of an incen- diary. g . Work has stopped on the Fiith avenue motor line and will hardly be resumed until certain arrangements have been made with the property owners. Tho owners cf the abutting property have unitea in an attempt to resist the progress of the work unless adequate damages have been secured. The eross-examina- tion of the first witness, Lars Jausen, was resumed yesterday morning, and continued, with the excention of usual noon recess, until half past 2 o’clock. The cross-oxamina- tion fuiled to break or materially affect tho evidence of the witness. Ho was not con- fused in the slightest degree, and gavo his teatimony audibly and clearly. The defense evidently believed that the burden of the case for the state rested upon this witness, aence the long and wearisome cross-examina- tion and aliempt to shake his testimony. Tha second witness called was Oliver David, another young farm laborer_from Hazel Dell townsbip, who was in the city on the day of the murder and witnessed the shooting. His testimony corroborated that of Jensen, was clear and positive, and was not affected by cross-examination. After an hour’s siege on tho witness stand he was dis- missed und Sam Smith called, Smith was in David’s company at the time of the shooting, and both stood looking in the door of the 'saloon when the fatal shot was fired, HIs testimony was a repetition of that of Jensen and David, with the single ex- ception that he said that tho victim, Do Goode, was facing south when the shot Was fired, while the others stated that he was facing nearly n Dr. F. P Belliuger was the feurth witness and his evidence was entirely regarding the fatal wound, the course of the bullet, and the post mortem examination, Tho fifth and last witness of the day was Tom Casey, who was in the saloon when the murder was committed. Ho was attracted th the spot by the quarrel botween De Goode and George Guanclla, and saw the vietim fall dead, His examiuation was not completed when the clock struck 5, and court adjourned until 10 o'clock this mornin The attendance was about the as on the preceding day, specta- tors constantly coming and going. There were a fow more wowen inside the railing than had been seen there before, and they listened carefully to the evidence intro- duced, evidently takiog much interost in the case. The defendant appeared to feel a little more nervousness than he had preyiously ex- hibited, and was quite uneasy during the di- rect oxamination of the witnesses.
