The attorney-general received word this morning that the treasurer and sheriff of Chase county were in n muddle, baving crossed swords with the judge of the United Btates district o It scems that the “Kit Carter Cattle Company ve E. Arterburn, treasuret nd George W. Rogers, sheriff of is tho title of a case in the circuit court, pending trial, and, that an in- junction was served upon Colonel E. D. ebster, receiver of the Harlan Cattle com- pany, restraining any disposition of ton head of horses he had in his possession upon which the plaintiff, in the causc as stated, had & proprietory lean. Notwithstanding this, however, the sheriff of the county seized upon the horses in controversy by an order of the treasurer and advertised their sale to liquidate a claim for taxes which the county and state had upon the original own- ers of tho horsss. This, let it be remem- bered, was done in the face of an injunction granted by Judge Dundy. Now comes the return play. Service has been made upon Arterburn and Rogers to_appear before the court and show cause why due respect was not shown the order. May i3 is fixed upon as the day of hearing, and it looks a little as though the Chase ofticials hud a big e of contempt on hand. To make the matter more plain, it is well to state the Harlan Catile company were the owners of the horses, and that thoy were held by the Kit Carter Cattle company. on a mortgage, to cover legitimate debt claims. Before fore- closure was sought, howover, the horses were seized by the Chase authorities, but the order of sale had not been made, To pre- vent this, the injunction was served. With- out considering it, however, the horses were posted at shorif’s sale to cover the claim of the county and state for taxes. The attor- ney-general will takeahand in the fight uow, and he hopes to be able to clear them on the charge of contemot. Tiquor Law Violators. The case of the stato vs Moses Smith and W. Kief, was on trial in the district court, to-day, for selling liquors without license. The allegation is that they were running a saloon on Tenth strect, a_little north of P. Teseems thata license had been granted to one Mahoney, and the defendants claim that they wore merely there as his ageuts, Smith bong in charge and_Kief the bar tender, The state says that this wasa transfer of the business, which could not be permitted under the law_regulating the salo of liquor in the state. It is loarucd that the trial of this causo _can not be concluded, to-day. Judgo Field and a_jury are trying the cau The second court was also grinding to-day, Judge Chiapinan presides. The case in hand 13 Cooper's mandamus on the ecity council to compel the council to canvas the votes for his short term as councilman on the gon- eral election day. It is stated that tho court, will undoubtediy deny the writ. The case in quo warranto also pends. This is simply for the ouster of Hamilton as councilman of the Fourth ward and the re- instatement of Cooper. These cases excite the interost of tho Fourth ward and the en- tire eity council. The outcome is watched with as much interest as though a life hung in the balance. Attempted Incindiarism, An attempt was made last mght when tho wind was highest, to burn the rosidence of W. E. G, Caldwell, who ves near the cor- nerof M and Fourteenth streets. The at- tempt was discovered by singular fortune. J. 0. Bennett, the artist, who lives. in the bouso adjoining the Caldwell property, started to the theater and had forgotten his tickots. Ho returned to get themn, and saw the flames leaping to the ceiling 'in the par- lorof the Caldwell residence. It was tho worlk of a moment_to shout the alarm, and e dashed into the house and commenced to subdue the flames, but as he reached the room he was again startied by sceing a_man run from the basement into the strect and disappear in the darkness. Help poured into the house a moment lator and the flumes were queached, both in the parlor and basoment, where fircs had cer tainly been kindled. Tt was a fortunate dis- covery. Otherwise, high winds considered, that part of the city must have heen in ruins to-day; no clue whatever to the wmcendiary. New Creamery Company. A country creamery has boon establishod in the wostorn part of Cherry county, near Cherry Valley, the articles of incorporation of which were filed to-day. A petition for absolute divorce lms been filed in the district court by Mary Lyons, from her husband James, to whom she was married Februoary 4, 1590, at Brazil, Ind. She was then the widow of John Harrigan and the mother of five children, whom Lyons refuses to support. She charges him with cruelty on an average of twice a month and says he has quartered himself upon her for support and clothing. George A. Hoagland has brought suit gainst Peter J. Boyer for $96.60 with - terest, an amount claimed as still remaining due on abill for lumber purchased in 1887, John L. Paulson vs. Jobn J. Tho former, in one of the clauses to his aMdavit, states that if the horse car company claime the right under its charter, to use tho Six- teenth street viaduct, it has never asserted such priviloge and never applied for an ordy nance granting such right. In regard to the oute of the motor aiong Leavenworth to enty-fourth, thence south to a connection with its tracks in the latter street the affant states that there is about one mile of un- graded stroet on Twenty-fourth south of Leavenworth, which is wholly impracticable for railway use at present; that the motor has been anxious for the city to grade the stroet and has offered to build a tempor viaduct across the railway tracks on Twenty- r if the city swould make the grade, but the city was not at present in- clined to do so. Murphy, who resides on Far- nam street near Twenty-eighth, called at the ofice of th ard of public works yes- terday and complained that & number of men were at work tearing up a board side- walk in front of her house, which was laid only last fail. When she asked them what they were doing it for they said that were going to lay a stone walk there, objected,to this, saying she couldn’t a new walk, the wooden one having ouly been laid a few months. A morning paper revives the chestnut about General G. M. Dodge as successor of Charles Francls Adams as prosident of the Union Pacific. The “New York’ citation 18 based upon the interview with General Dodge by a reporter, which was published in Taue BEg about four weeks ago. General Manager Kimball did not accompany him on his tour as reported. A Good Move, In the running of dining cars on its trains the Union Pacific is the first and_only road to inaugurate this service west of the Mis- souri river. Its construction was be- gun more than ten years ago, and the total cost was $2,050,000." Toreka, Kan., May 7.—|Special Telegram to Tur Bre.]—On application of the Amer- ican Bell Telephone company, Judge Guthrie, of the United States circuit court, to-day granted an injunction restraining the Hutch- inson Telephone company from using the Cushman iostruments, which have been de- clared by the courts to'be an infringement of the Bell patents. He also allowed dumages as aslked by-the Bell company. el A Crooked Cashier Sentenced. Toreka, Kan., May 7.—[Special Telegram to Tuk Bee.|—B. H. Joues, late cashior of the First National bank, of Stafford, was, to-day, sentenced by Judge Koster, of the United States district court, to five years in the peunitentiary for making false entries in the books of the bank and defrauding it of $1,700. He was captured a short time ago in Pittsburg.
