A similar s issued some time ago, and was d for a while, but the saloonkeepers to gradually overstep the bounds and have lately been running openly on Sunday, and keeping open house ail day. The sections 3 and 4, to_ which the atten- tion of the marshal is called, read as follows: It shall be the duty of the city marshal to arrest ana take into custody without _war- rant or pr be found in any e public_place i ate of intoxication, or fighting, threat- ening, pilfering, robbmg or domg any act in violation of any ordinance of the city, and vring such person before the suj to be dealt with according to law. to be removed ed as provided by laws of the stute and ordi of th city, any nuisance found within the city limits. o -ute all processes or orders issucd to him ¢ the mayor, superior court or council, and duc returns thereof, according to the souglhit to enforcc upon the mind of the marshal that he is required by the ordi- nunces of the city to “execute allorders is- sued to him by the ma: Now, it 18 an open secret shal does not | obey the orders of the m nd positively refuses to do so, allegin s does not think that ness to fine the reason that th iayor is compelled to ask Chief Lucas to perform the work that rightly belongs to the city marshal. The marshal . | Ferguson in the lar openly refuses to cither collect the saloon fines, or to close up the smluans The result is that the fines are not although it has been med that lhc oon men were paying promptly. As u matter of record, not a single saloon fine was paid last month, and but four or five this month. The fresh outbreak of the saloon war has induced a few of the liquor dealers to come to time, but they are very largely in arrears, The mayor claims that he is in for blood this time, and that it is to be a plain case of “put up or shut up,” Tn his letter to the marshal, the mayor failed to call attention to the sec- tions that are of far more importance than the sections mentioned. They ave sections 2 and and read as follows: “It shall be the duty of the city marshal to cause to be enforced within the city the laws of the state and ordindnces of the city in re- lation to licenses and trafic in intoxicating liquors, the suppression of gaming houses and houses of 1ll-fame, also vagrancy.” Section 13.—*If he shall neglect or refuse to perform any of his duties imposed by luw or the ordinances or resolutions of the coun- cil, or shall perform the same in a false or partial mauner; or shall become a party to any crime, or encourage, or know- o ingly permitany criminal action, he shall be liable to forfeit to the city $0 for euch breach of his duty, recoverable in an action on his ofticial bond 'in the name of the city.” As nearly as can be ascertained, the mayor ts that if saloons do run they must pay + fines, and the marshal objects to ¢ lecting the fines. The mayor insists on hav- ing the fines, but is compelled to call on his chief of police to do the marshal’s work to help him get them. The disagreemerft has existed for some time and seems no ne a settlement than it was months ago. What the result will be it is impossible to say, but it is probable that the rupture wiliexist until both oficials unite inan endeavor to en- force the law rather than evade it. If Mayor Rohrer succeeds in closing the saloons on Sunday he will_be congratulated heartily by the@u and order classes. If he goes furtlier and puts an end to the boldness with which gambling houses and bawdy houses are conducted, he will add several more feathers to his cap, The lux f 1 and the publicity of busines: 1 city. The example should be followed by all other compauies having an interest in the miniature forest that adorns both sides of our principal streets. The telephone com- pany has painted @ few of its poles red and white, and the electric light company put & six oot base of biue on @ part of their wire supporters, but the move was not carried far enough. 1f the city is to be compelled to endure the nuisance, it should be mitigated @s much as possible by having the poles pleasingly painted. It would also assist in readily distinguishing the property of the Various companics. When the mattér is summed up it will be found that there are several companies in the field, and that there must necessarily be a great many poles. Through the business part of the cjty are located the poles and wires of the Western Union telegraph com- Americn Distriot telegraph company, actdo Mutua telegraph conipany, Towh s Nebraska telephone company, Council Bluffs Electric Lighting company, oity police and fire alarm, and the Omaha and Council Bluffs Blectric Motor company. Negotiatic s are now pending for the loca- tion of an incandesce in the city, and it will be n also to erect a line of poles This will n.ake eight companies them here to stay. The principa already erowded with the but thére seems to be no prospect of relief. The net work of wires has becgme so dense that the telephone company has already adopted the cable system of Bunching its wires for the distance of a few blocks from the central oftice, This disposes of the difficulty regard multiplicity of wires, but it ufiuhh 10 for the pole nuisanc t as many poles as the individus The variou anies object to the under- ground system, alleging that it is very ex pens as_well us unsatisfactory in its workings, It looks as if the city would have to submit to the present system for a while longer at least. The council has at last con- cluded that it would be well to confine the poles to the alleys ns much as possible, and it is quite probable that this will be done in the future. As far as the electric motor line was concerned, the poles had to be placed on the strects, if they were erected any- where, but it scems that even in that case the city council of Omaha got the start of their Towa brethren, It is understood that the electric motor company will be compelled to el a line of handsome, iron poles if they wish to traverse the Omaha streets These would be quite an improvement over the plain, wooden sticks that aro getting to be a conspicuous object of _dis- figuration along onr principal streets, Now that they ave erected, it will be the least that the companies owning them can do, to paint them and make them as presentable as possi ble. The little already done in this direction ha o a great improvement in the appear- )f the strec nd 1t is hoped that the council will at once take steps to have the work continued. 1 over the city. all of streets are e %ine holiday goods for twenty d prices that will surprise you, ¢ be convinced.
