Tt Will Not Be Tested in Bud Lindsay's Case—Trouble in Ethiopia— Btate House Items— City Briefs. 1020 P Streer, LiscowLx, May 24, The county commissioners and County Clerk Bell, who went west several days ago to make an investigation of building stone Weforo deciding what material to use in the mew court house, reached home by the de- fayod flyer last night. They were accom- panied on their trip by the architect, Mr. F. M. Ellis, who went to Omaba instead of re- turning here with the board, but came down re this afternoon to give the board the mefit of his juagment when they make Rheir final decision. The bid of W. H. B. Btout, which the board decided to accept, ‘was a double-barrelled one. He made a bid an which he proposed to use Uolorado red sandstone and another in which he contem- plated using Ohio blue stone—the latter bia being $3,000 higher than the other. The board visited Cheyenne, Wyo., where the new Union Paciflc depot building is built of rod sandstone. Thoy then went down to Fort Collins, Colo., and visited the quarries which are about seven miles from that place. They found that the whole carth is under- ald with stone in that vicinity and that there s no danger of tho supply running short. F'rom Fort Collins they went to Denver and inspected several large buildings in that cit in the construction of which the red sand- stone was used. WILL NOT TEST THE ORDINANCE. The attorneys for Bud Lindsay, who had given out that they would test the city liquor ordinance by allowing Lindsay to go to jail nd then applying for a writ of habeas corpus ‘rom the supreme court, decided not to do so, thiefly bocause the supreme courtis not in session and they could not get a writ, how- 0od a case they might bave. Lindsay puan trial yosterday afternoon. Police- man Tubman ed that he had got beer in bottles at Lindsay's Sunday night. Two g!.hur witnesses stated that they had bought fincol.x Burgav_or Tre Oxama Bes, } ottled beer in the afternoon of the same ay. None of them bought it of Lindsay, and they could not tell whether the person of whom they bought it was in Lindsay’s om- loy or not. Lindsay testified that'he had losed up at the proper time and given his elp strict orders not to sell any liquor until onday. The court discharged the defend- wut, holding that the witnesses had failed to onvict Lindsay with tho sales and that the stimony of men who decoyed another into he committing of a crime for the purposo of forming upon him was not worth enough to arrant a conyiction on it alone. > THE WAR IN APRIOA. Two suspicious-looking individuals, each with a large bundle of clothes, were discov- ered by the police about 11 o’clock last night near Krug's brewery.
