The Council and the Cable Ordi- nances—The Bicycle Race—A Fight Between Lightweights ~Other Local News, The Cable Litigation, In the United States court yesterday Judge Dundy rendered a decision in the matter of the application made by the Omaha Horse Railway company for an injunction restraining the Omaha ( Tramway company trom layingits tracks on Tenth street and elsewhere in the rity on streets occupied by the plaintifi”’s tracks. The court gave a lengthy opin- ion, reviewing the case and commenting upon the franchise rights of the two cor- porations. The court denies the perma- nent inljunr-l'mn asked for by the Omaha Horse Railway company, but holds that the Cable Tramway company shall be responsible fo 1 damages sustained by the Omaha Horse Railway company by reason of the Jle company's tracks running p lel with or across or in anv manner interfering with free and unin- terrupted access to the Omaha Horse Railway company’s tracks; the damages sustained to be determined by commis sioners to be ‘ll»|mu|lu| h) the court. The 1ucorporators are William A, Smith, Frank Murphy, Guy C. Barton, and George E. Pritchett, the oflicers of the Omaha Horse Railway company. The capital stock is placed at $1,500,000. The company state their n- tention of constructing a cable street railway in the city of Omaha upon some of the following named strects. Tom Miller, of Dubuque, Ia., and Johnny La Mountain, the Omaha light weight, were matched for a twelve-round fight with four-ounce gloves in a private room in the southern part of the city, last night. About 200 people were present. Miller stripped at 122 pounds and La Mountain at 125. Both men were in ex- cellent irim. Charles Moth acted as ref- eree, Ed Rothery and Jim Connelly as time keepe Paddy Norton seconded Miller, while La Mountain was seconded by Jimmy Lindsay.
