C. tract, forming what is known as the Omaha addition to Council Bluffs There was a large plat of these lots on Odell Bros. & Co.’s office, and a thr stood in front of it all day. Welch, 615 Main street, telephone § - The District Court, Yesterday the jury in the case of Heaton against the Chicago, Burlington & Quincy Railway company decided in favor of the defendants. The case was brought to make the railway company pay for the burning of Heaton's coal sheds, it being claimed that the tire or- iginated from a spark from a passing switch engine, and that the company was responsible. The suit has been hotly con- tested for a day or two in court, and the railway company wins this first round. lu the district court yesterday there was a dearth of attorneys. Whether they were all buying real estate or otherwise engaged is not known, but the bailiff had to run all over the city to secure the pres- ence of any attorneys, and the hour of opening of court was greatly delayed by their absence and the neecssary hunt Yesterd ternoon the court again run out of lawyers, and after making another attempt to get some of them to come n and thus permit some motions to be d, the court adjourned.
