The New Justice Law and tho Ends Sought to bs Accomplishea by It, The new justice law which was passed by the state legislature last winter is just now attracting conslderable atiention on account of the action recently takenby the county commissioners in districting tho olty In accordanca with its provislons. As different opinions have baen expressed as to the objects of the law and its probable effect, a BEE reporter called on Hon. A, C. Tronp, who drafted the law and pushed it through the leglslature, in order to learn the caus:s which led to lts adoption, On the reporter stating his errand, Mr. Troup stated the case as followa * “Under the old law the city of Omaha has twelve justices of the peace, two for each ward. Out of the number only elght are acting fn thelr officlal capacity, there not belng enough business to keep them all busy. In fact there is not legltimate business for the eight, and ople who had been watching the con- g:nt of the justices' courts, came to me last winter to have a blll drafted to re- duce the number. Among thoss In favor of the new law were somo of the most prominent people of the clty, including large numbers of attorneys. The re sons given for desiring the change were that there was not emough business for 80 many justices unless they could manu facture petty and disreputable cases. That sach business was carrled on ina good many instances there is no doubt. A justice would act ss counsel for & client who hed & clalm for two cr three dollare, and would induce sald client to have the case tried before him, for the sake of recelving the ccsts. Other means were also adopted, to make the butiness a paying one, which were far from legiut- mate. “'This state of affalrs was well-known to nearly all the lawyerz in the clty, and the object of the law was to so reduce the number of justices as to enable thoee acting in that capacity to make a falr ealary in dolng legltimate business. The salary of a jastice Is entlrely derlyed from the fees recelved, and by thus putting the business of elght into the hands of three tho position will be a more luorative one, This will tend to ralse the standard of justices of the peace, and men of abllity and character will be eecured to fill the place) “Although complaint {s made that three justices cannot do all the work, I think that when the plan is trled 1t will ba found that they can. If they cannot, it will ba an easy matter to amend the Iaw and incresse the number to four, I will take the responsibility of the matter on my own shoulders, and I think that the results attained will prove conclusive- Iy that the law is & just one. A. Smith, superintendent of the Omaha Street Rallway Company, for dis- obeying the terms of the ordinance re- cently passed, ordering the street cars to be run every ten mlnu‘es over the lines operating within the olty limlts. All the parties conocerned, Inclading the officials, were very reticent about fjthe matter at first, but all the facts were gained after some trouble. Yesterday af- ternoon Officer Cormlck took the warrant out and geommenced looking for Mr. Smith, and ere this time that gentloman Is doubtless in the “‘clutches of the law. The complaint was sworn oat by Mathewson T. Patrlok. It may be remsmbered that last weck this gentleman applied for a wrlt of manda- mus from Judge Neville to compel the street car company to operate thelr cars In the addition to the clty, known as Patrick’s additlon, as, 1t was alleged,they kad contracted with him to do. Before Judge Neville had tlme to inquire Into the matter very far the defendant corpc- ration filed an answer that they dld main- taln and operate a street car line in Patriok’s additlon—thus enterlng a flat denial to the allegatlons of the plaintiff. Nothing new developed in the matter untili Monday, when as mentioned fn these colamns, Mr, Patrick commenced = snlt in the distrlct court, claiming $16.000 damiges from the street car company. 1t was al- legod in his petition that last spring he donated to the street car company §6,000 worth of land In Patrick’s addition, with the understanding that it was to operate s:reet cars on Lake street, from Eigh- teenth to King, and north on King, as extended to olty limits, This the com- pany had failed to do, and it was alleged that the property in the addifion had de- preciated in value about $10,000, making the total loss to the defendant cne of $16,000. Thls, In brief, s the general history of the case, Mr. Patrick, wishing to force the case to ue, swore out the com- plalnt In the police court, which charges that the rallway company did “willfully and unlanfally fall and neg- lect to run street cars in each direction at Intervals of at least ten minutes from six o’clock in the morning until eight o’clock in the evening of said day, on the line (f strest rallway under the control of him, sald Willlam A. Smith, extendiog west on Lake strest, from Eighteenth street to King street, and dn King street as extended, north to inter- section with Lake etreet, In the clty of Omal Sald fallure and neglect to ran sald sfreat cara on eaid streets was not caused by accldent or unavoidable canualty.” Mr. Patrick was met on thestreet yester- day by a reporter, but gave no Inferma tlon additional to that contained in the petitions filed in the district court. He said that he had given the land to the company with the understanding that they wera to operate tkelr line in his ad- dition, They had failed to do it withinthe glven time, June 30, 1885, and the peo- ple in that part of the clty wers very much Inconvenlenced by this neglect to ron the street care. He proposed to bring the company to time If possible. Mr. Smith, the superintendent, was also eeen by a reporter yesterdsy and sald that he did not care to express himself freely about the matter. It would bs shown upon trlal whether or not the com- pany had failed to operate the carsas Mr. Patrick had charged. ‘I can eay this much,” he remarked, ‘‘we do oper- ate the oar line on Lake to Saunders and from Saunders on to King.
