It was evident at adjournmoant on the previons evening that ths defendant had In the court’s jadgement scored its point and at noon yestorday, despite the morniag efforts of the plaintifi’s counsel, Judge Dundy ordered the modification of thelnjunction, His order was merely verbal and In a general way released the Belt line from restraint except upon thess points alone: That no new directory ba elected, no offiolal board created, the property sball not be sold and that no mct ba done which will destroy or impalr the mechan- fc's lien held by the Unlon Pacific for its claim. Mr. Pritchett, counsel for the defense, was In o most complacent mood when approached for his opinlon of the fall significance of the result, He held It was a virtaal dissolution of the Injunction and the scoring of & point which would bear groat welght upon the final tssue of the sult, which now rests for, perhaps months to come. The sworn state- ment of the former is a perfect epitome of Mr. Clark’s position, and is glven in full below. “Frank Murphy being duly swoen, says th he was one of the incorporators of the de- fendantin the above entitled cause,—the Omaha Belt railway company—and one of the original stockholders thereof and was, on the 16th day of November, 1883, duly elected & director, and the secretary and treasuror thereof, and 18 now and ever ince said day of November, 1883, has been a director and the socretary and treasurer of said Omaha Belt railway company, That John M. Thurston was the eecretary of the incorporators of said company and had porsession of the books and subscription lists and all papers and booka of the company until about the 1st of Jan- uary, 1885, whon the said posseesion of the same was deliveied by tho said Thurston to deponent as the secretary of said company, snd deponent has now and ever since about January 1, 1885, had the exclusive possession of all the books and papers of said Omaha Belt railway company as the secrotary there- of, and that said defendant, Clark, never had any possession of the same’ whatever, except a8 the agenc of said Thurston to deliver the same to deponent, which sald Clark did by receiviog said books and papers from said Thurston, and delivering the eame_to depon- ent as such sectetary on the same day. Deponent further eays that there is now in his hands 1n cash and checks about 850,000, of which sum $42,000 is in cash, and that de- ponent holds the same as treasurer of said Omaha Belt rail way company. Deponent farther says that said company has means and is able, if not enjoined by the court, to build and complate its railway as it had commenced to do at the time of the com- ‘mencement of this actiol Deponent further says the scheme of organ- izing ssid Belt Line company originated with defendant Clark, and that bafore the organi- zation thereof said Clark on several cccasions stated to deponent that his purpose was to bulld a railway—a Belt railway—at Omaha, which should furnish terminal facils ties to all the railroads running into Omaha and that he desired that all such railroad companies should have an interest therein, but that the same should not be controlled ex- clusively by any one of them. That at the meeting at which said Clark was elected pres: ident of: said; BeltRailway company, dep- onent proposed his name for preeident, but eaid Clark objected on the ground that as he then general manager of the Union Pacifio railway company, it might look as though the enterprise was » Union Pacific schemo, which it was not, and some dizcussion of the ques- tion was had, and it was_finally determined that it would make no difference, and the di- rectors elected said Olark president of the company, Olark all the time urging that de- ponent or Guy C. Barton should be elected such president.
