Mev, McK ‘s Departure—Monday Night's Concert—The Military Company—uapital Brevities, AT THE OAPITAL, LANCASTER COUNTY'S BOND CASE, The brief of the respondents in the caso of the State of Nebraska upon the relatlon of Joseph R, Webster vs. the Board of Connty Oommlssloners of Lan- caster County has been filed, and the oate will probably ba argued next week before the supreme court, This is a case of agood deal of Interest to {hs tax. payers of Lancaster county, and, in fact, to the people of the whole state. In thelr declsion the supreme court must determine largely tho scope and power of boards of county comm!'ssloners through- out the state. Although brief mention hae been made heratofore of this case In the columns of the Brk, it s of sufficlent fntorest and Importance to four people here to warrant mors extended notlee than it has hereto- foro recelved. It would take a page of the Bee to enter fully into this case, bat 1t may bo rummarizad as follows: May 24 186!, the electors ot tnis county voted to iseue to the Burlington & Misouri River Rsilroad Company in Nebraska, county bonds In tho sum of $50,000 t) aid the constractlon of it road feom the Missourl river to Lincoln, in said county, avd by thelr terms they were made payable to sald company or bearer on or beforo the explration of twenty years from date, with interest &t ten per contom per annom, payable annuslly. Sald bouds were itucd by the county, and dated July 1st, 1870, payable on or bafore twonty years from date. October 24, 1870, bonds in the eum of $150,000 were issued to the Midiand Pa- cific rallway company, with tho same goneral provislons as those lssued to_the Barlington & Miseourl as above specifiad, excepting they ware payable on or befors twenty-five yours from May 1, 1871, November 28, 1871 another issue in the further eum of $100,000 wes made to tho Midland Pactfic rallway company, with the same provisions as above, ex- cepting they wors psyable in thirty years, The redcomable character of these bonds, Mr. Webstar clalms, had been lost sight of, through some error in the make- up of the b.nd register, and was unkaown to any of the county officers or to the relator. Mr. Webater turther says that in 1879 Lancaster county floated saven per centum interest bearlng bonds, and dur- ing and after 1880 the county could have refunded Its raflroad bonds at six per centhad thelr redeemability been known. Farther the relator saye, in the month of Decemb:r, 1883, he began an investl- gation into the history of the bond debt of tho county, and ascertained that the bonds were payable on or before their respective dates of absolute matur— ity, while the bond register indlcated that the bonds were not redeemablo, bat wera payabls at absolute periods, In Febroary, 1884, Webster entered into A contract with the board of county commizstoners, by which he was to un- deriake to effect the surrender of euch bonds at par, snd to fund the same at a lower rate of Interest without any cost to the couaty, in cise ho was uusaccessful, and for compensation he was to roeceive such premium ns the six per cent bonds as refanded might bring. At this time there was outstandlng of such bonds $267,000. By bis eervices Mr, Webster claims he effscted & reduction of the in- terest charve for the year commencing May 1st, 1884, of $16,600, and a total eaving of Interest to be psid upon the 83id three serles of bonds during the un- explred per:dons of their suppeed and apparant termv, fto run as fo'lowe: B. & M, sorles, $2,100;, first series Mid- Iand bonds, May lst, 1884, to May lst, 1896, $72,000; second s:ries Midland bonds, even if valuad, May lat, 1884, to Jan. 1at, 1003, §74,666; or a total sum of $148,706 In April 1884 an actlon was brought by a tax-payer to restrain the county com- m'syicners from complylog with thts contract, and by an egreement with Webster and the com- missioners the contract was annulled. Now comes Webster and clalms on a quantum meruis $14,866.60 for servicos rendered, and aska the supreme court to Issue a writ of mandamus compelling the county clerk to draw a warrant on the county treasurer for the amount, and {f no fard exlsts from which the claim can be pald, that the county commlissloners be compelled to make a levy for payment of the same The respondents, in their brlef, deny the right and power of the board of county commissloners to enter inio such a con- tract. The declelon of this case, as we before ssld, involves a great deal of law, and should it be decided in favor of ‘Webater, opans a wide field of new power to boards of connty commissioners, which now are considered as only qoas! corporations, clothed with only such owers as they direstly derive from the egislature, and are strictly confined to them by both the common and statute law.
