A Variety of Intercsting Litigation Started Yesterday, The Uity Has Its Full Share, Yesterday was & lively one In the office of the clerk of the courts, and both Sheas were kept on the jump, for It was the last day for fillng cases for the coming term of the circult court. By supper time there had been over fifty cases filed, and the clerk had to promise to come back in the evenlpg and keep on recelv- Ing. A large number of the cases were of little public Interest, but among tho others were eeveral worthy of news note. 1t was noticeablo that the sults against the clty are still fashionable, and among the new ones is one In which Judge James, wno has himself served as mayor, and as alderman, s the plalntiff. He claims $800 damages on account of the Indlan creek ditch, which runs near some lots owned by him in Everectt's additlon. J. H. It 1s claimed that the train was so made up that there were box cars In front of the englne, as well as behind It, and the en- glneer was not able to see anything on the track either way, and that no signal waa given, when the train startad, the cara hitting the little fellow, and so fn- juring him that he dled soon after. Wright & Baldwin, who served as attorneys for Wm. Brix In a cacs against the city, now commence eult agalnst him. for £200 fees. Olive Weidner asks for a divorce from her husband, A. The financial effairs of the driving park association are brought into court by an attempt to foreclose the mortgage on the grounds. 1t is hoped by those in- terasted, and who have kept paylng lib- erally from their own pockets to keep the enterprise going, that the finances may be arranged in some manner, so that a fall meoting may be given, and the track malntaioed, but this is all in doubt, and the sky looks threatening. Dr. Wes! CAPTURING A HORSE THIEF, A Pair of Slippers Serve as an Impor- tant Oluo, ——— t, dentlst, over BEE office. Sheriff Farrell arrived last night to get the horse thlef, Dalton, arrested by Offi- cer O'Brlen, for steallug a horse belong- ing to Mr, Nazwrenus, of Mills county. O'Brien has had rather & queor exper- fence with Dalton, The first tlme he oaw Dalton was on {ho16th of last month, and It was a chance meeting, which prom- ised no such sensational finale, O'Brlen stepped Into Phillips’ store to see about some ehoes for his wife, and as he en- tered Dalton sat there trying on some very fine slippers, O’Brlen did not know even the wan’s name and would not have thought anythlng more aboul it had 1t not been for subse- quent circumstances, The coming In of O'Brlen caused the clerk to make some joking remark to Dalton about the pollce, and Dalton casually remarked that if the pollco got after him for anything, and he had not been dolng anything wrong, he should let them take him, but that it he had been in a scrape, and was gullty, he wonld not let any officer take him alive, Nothing was thought of the casual meoting, and O'Brien did not see the man sgein, and never thought of him, until the other morniog he saw him comtng down Broad- way rlding a horse, and having on his feet the slippers, which had luncted the officer’s attention before, A few hours later Nazarenus came to the clty to see If he could get any trace of hys stolen horee, #nd the moment he described the animal O'Brien remembered that he hadseen the man on the horse that very mornivg, and he started out on the rearch. The horse 8 broken ehoe, which made the tracks easter to follow, but the thief went across lots, aad through fielde, and the tracks were lost several times, but gome of the fumates of a farm house noticed a man golng by on horseback, and wearing slip- pers, and thus the traca was kept ap, until it ended in the cap- tare of the man and the animal. The fellow was tracked Into a thicket and #as there surrounded by about twenty fsrmers who had jilned {n the chate When canght he rewarked that If he had only his two revelvers with him he would THE DAILY BEE- never have been taken alive, bat he had to yleld. The report that he belongs nesr where the horse was stolen proves to be a mistake, there belng no one who remembers of seeing him in that viclnlty, WHERE ARE THEY? A Worse Cause of Complaint Than Several Cemeteriee, Couxcin Brurrs, Tows, August 6.— What in sheol has bscame [of our may. or and olty dads who we elected to look after the whole interest of our city? Have they got lost In the woods, or have they olimbed St. Jacob's ladder and pulled the ladder up after them and stopped up the hole? There was a petition clrculsted over a year ago signed by several han- dred taxpayers and residents living north, south and west of Indisn creek praylng for Immediate rellef from the overflow of said creek. We did hardly think that angust body, the board of health, would use the creek for sewerage purposes un- tll properly improved. To send down tho dirt aud filth of several thousand cit!zana to fill up our ditches and wells, and polron the atmosphers by reason cf decaying vegotation in standing water to destroy the health of ourselves and fami- Ies. Oh, Lord ! when are we golng to get relief from this mitigated nuoisance. The very atmosphere fs poluted with righteons indignation against this long neglected abuse, and the cry of ven- geance and even profacity is ascending to heaven against those in authority who we delegated with power to act. The women are organizlnga vigilance and re- lief committee to walt on him who promised so much before election, and if they can lay hands on ‘‘the mayor of 1.y clty,” they will glve him a bath or drown him In the filthy water standing around thelr homes, Why, the very dead In Falrview cometery are turning over in thelr coffins, and demanding to have the lousey creck nuisance abated, and are golng to serve an injunction on that miserable syatem of sewerago. If the board of health and elty council does not glve immedlate relief they will see some- thing more than spooks, for they will have to appear against them In the day of judgment, We ask you to hurry up the contractor to complete that work, ot we will have to put cayenne pepper In hls boots, or snakez. We do not want the repetition of that old saying: **We have left undone the things we ought to have done and done the things we ought not l\ava d o e —— IOWA ITEMS, Cedar Raplds claims to have a half mlllion dollars’ worth of new bulldings under construction.
