The Motion for a New Trial Not Yet Argued, It seems that the motlon for a new trial In the star route cares of ‘U, S. va, Thev Parker,” of Atchison, Kan., which was to have been argued here before Judge Dundy last Tuesday, passed by without any particular reason therefor, more than that Col. A. S. Everest, attor- ney for plaintiff, had to bo away at that tlme on buslness at some other place. The cases were tried before Judge Dandy In June at Topeka, and as the plaintifis live In the Kansas district it is only as they please to feel about the matter whether they come here to have the motlon fora new trlal argued or compel Judge Dandy to go down there agaln. Mr. Douglas, who s assisting as special attorney for the governmwent In thess cases, says that the rosult of this particular case will shape his actlons regarding all the others, At least there will bo mothlng done with them until the Parker case Is disposed of. e —— Ohilaren’s Party, A most dolightfal children's party was glven on Friday evening at the resldence of Mr. anc Mrs. W. V. Morse, on Capi- tol avenu( Thelr children—May, Flor- ence, Et el, snd Robert—entertalned thelr many friends from 4 to 8 o’clock in very handsome manner, The grounds were attractlvely arranged for the occa- sion; music was furnished by the Ttalian harpers. At 6 o'clock an elegant Tunch was spread. The party was a very happy gathering of the little folks, among whom 1t was quite a soclety event. 1t wlll not soon be forgotton by~ those who wero present, among whom were the fol- lowing: Helen and Gertle Adama, Sadle and Lillle Alexander, Bertle Bal- bach, Margaret, Carl and Willle Barn- ham, Joe Barker, Minnle and Loule Bech- el, Sadle, Margaret and Stores Bowen, Jay Boyd, Sam and May Burns, Sam and May Calloway, Allce and Warren Chase, Dariing Coe, Ganily Coburn, May, Willle and Edna Cowin, Bessle Cooley, Ross and Bessle Towle, Freddie Lake, Lulu Dolsn, George and Mamle Dandy, Frank Duke, Lorlmer, Esa and Dannle Denlse, Grace Detwiler, Fannis and George Gll- bert. The ball last night at Hoffman’s hall, on South Thirteenth street, for the ben- efit of Mrs, Mary Susterltz, who lost her two little sons last week by drowning, was largely attended and was a grnd succes in overy particular. The ball was doubtless the best conducted one over held In South Omsaha and all who at- tended had a good time, The muslc by Prochaska’s band was excellent and words of pralse were hcard. About 11 o'clock a fine lunch was spread and all wore ready to partake. The net recelpts of the ball were be- twoeon $350 and §400, which sum will greatly ald the unfortunate woman, There was no man who was In any way connected with the arrangements of thie ball who is entitled to more credit than is Pollceman Peter Ma'z By his own porsonal efforts he eold over three hun- dred ticket and also managed tte ball, Mrs. Sutoeritz desires to extend her thanke to all who arslsted hor In any way at this ball, and especlally to the mem- bers of the polion forcs who were prenont. i Onfirst ¢l Dusiness oify property, for 0 per M54 04 ng the polichmen yresent wers Mar- | cent. This 1s a bad crossing, as the engineer and street car driver cannot see each other before It Is almost too late, and as there Is a big grade the engine has to pushhard to over- come the grade and curve. There was no slgnal from the englnewhen it started. Uars aro contlnually standing on Oallfor- nla street loading and unloadlng, much to the annoyance and peril of the resl- dents around. I have twice noticed that the boys playlng on the ocars released the brakes and ron the cars down to the yard, If there ls not a watchman put there soon, an accident will happen., The railroad, after ruining our property, seems to try to make It as uncomfortable as possible for us. Please glve thls room In your paper to glve us a littlo better protection for life and limb,by forclng them, through public sentiment, to have a watchman statloned at Thirteenth and Callfornla ntreets.
