THE DAILY BEE---TUESDAY, APRIL 14. 1885, THE OITY CHARTER, Toe New Magna Charta Which is to Coatrol the Career of Omaha, A Complete Summary of the New Provimons Introdunced, Clty Attorney Connell hascompiled a copy of the city charter, which has been printed and is now ready for distribation among the choten few. The document s one of ifty-four pager, and has already been extentively reviewed in these col- umns. A brief abatract of the new fea- tures introduced Into the charter, how- evor, will begiven. Tho title of the law Is an act Incorpor- ating cities of the first class, and regalat. Ing the'r dutles, powers and government, as amended. Section 2d creates the new office of city auditor. Sectlon 12 provides, among other qual- ifications of the councilman that he shall be required to give a bord to the city, with two or more grcd and suflicientsure ties who rhall each justify that he is worth at least two thousand dollars over and above all debts amd exemptlons, and the bond shall be conditional that if the councilman shall vote for any expendi tare or appropriation of money, or the creatlon of any liability In excees of the amountallowed by law that the council- man and sureties signing the bond shall be liable thereon, Attlele 3 of mection 16 provides for the suppression of oplum dens popularly known as ‘‘hop joints.” Article 8 of Section 16 1s s0 amended a8 to regulate also the use and ea'e of electrlc lights, the charge for electric light, and to require the removal from the streets, avenues and alleys, and the placing under ground of all telegraph, eloctric and telephone wires. Article 2 stpulates that the clty coun- cil shall have the power to locate such market houses and market places, on any streets, alleys x pablic grounds, or on any land parchased for sach purpose. Article 34 provides for the appropria- tlon, if neces ary, of private proparty for sower purposes In article 414t the councll is glven the power, also, to regulate and prescribe the timo and manner of runolng street cars within the city, and require tho heating and closning cf cars, and to fix and de- termine the fare to be charged. Sectlon 46 18 to create a board to be known as commlssioners of adjustment, to be compoeed of the city enginesr and two competent surveyors or civil engi- neers, who shall, as soon as practicable, preesed to survey all lote, blocks, streets, alleyo and public grounds within any city of the firast claes, not surveyed and platted with fixed monuments and re- corded; and such additions’ within the incorpurate limits of such city where dis- crepancies or uncertainties may exist as to the lines of the street», alleys, lots or blocks in such addlticn; snd to mske maps of thelr surveys, showing therecn tho width of every streot and alley, and tho extent of all tquares, parka and pub- lic grounds, and to fix snch msnuments as may be nacessary for the pressrvation of all lines eo estavlished. The section, farthermore, gives the bosrd to act in an adjudicstry capacity upon all grievances presented by tax- payers, and provides for the apgeal to the district court from any acsession rendered by the board. Section 22 provides for the issuance of bonds; among other purposes for that of taking up and making payment of the floating indebtedness snd lisbilities ot thecity. Boyd's Msjority by the Returns One Hundred and Seventy-Seven, The clty conncil met in thelr council room last night at 7:30 o'clock, and pro- coeded, pursuant to lsw, to canvass the vote and declare the result of the recent city electlon. Actiog Mayor Murphy, president, and Councllmen Anderson, Pechel, Behm, Ford, Faray, Hascall, Kaufman, Leeder and Redfield were present. Mr. Murphy explained the object of the meetlng, and Moatra. D. Keniston and E. W. Simeral were appointed canvassers, who, along with Uity Clerk Jewelt, procoeded to open the ballot boxes which had been turned over to them. Tha councllmen elect present wero in- vited inslde the bar, and Meesrs. Baily, Goodman and Lee entere: took seats. Returns from all the wards were found to bo regular, except those of the first district of the fifth ward which were not tigned. Mr. Murphy put the question, 1t these should be counted, and tne coun- cil ordered that they be counted. Dariog the tedious count the members gathered in knots about the hall and told Jokes. Caught In California and to Brovght Back to Nebraska. be About the mlddle of latt March the in- dlvidoal whess name appears at the head of this article came from North Platte to Omaha, where he had borno a good name for honesty and capabllity In business affairs, He repreeented to acquaintances hete that he had so proepered in his home fatther towards the sunset that he was about to open a banking house at Gutten- burg, in Dawson county, Nebraska. He represented his property and pos- sesalons 8o finely to the business people of Omaha that one of them, Mads Toft, Esq., a well known merchant in the gen- oral notions businers, and formerly of the People’s bank, trusted to his representa- tions and eold him 773.5: worth of bank fixtarss, such a3 desks, eafes, counters, ete. Stolle represented among other things that he owned §10,000 which he had in the Ncrth Platte bank, and besldes this he bore a letter of porsonal recommenda- tion from the Omsha Natlonal bank, which he pretented to Mr. Taft. Upon this showing Mr. Taft gladly sold his then useless furnitare to him. Stolle shipped the furalture to North Piatte and thero sold it for cash to another party who had a real bank, pat- ting the money in his pocket. Some time after ho left this country and his creditors began to ‘‘smell” not only & mouse but a rodent with a remarkably long eaudal appendage. Investigation followed at once and re- sulted In awakening suspiclons at North Platte as well as in Omaha. Stolle had been cashier of the North Platts bank,and Omsha experts are now at work on the books of that bank to mee what that slick rascsl did for that institution It is at this writing known that he, having charge of the books, *‘doctored” the entries and accounts there g0 as to swindle it out of some $10,000. He s & shrowd fellow and until the experts re- port there 18 no talling how he *‘tixed”’ the books of the North Platte bank. Bat A. Like many other men he put bis trust in a woman to keep a secret, little dreaming that an Mr, Toft sent his attorney, W. H. Martin of Omaba, to North Platte, where Stolle’s wifo was llving, who proceeded to ingra- tia‘c himself Into her favor and confi- dence to such an extent vhat ehe showed him a telegram from Stolle dated San Jose, California, which told her to be of 50d cheer, that ho would scon_send for her to join him in that land of grapes, ploeapples, figs and flowers, and hand in hand they would pass their remeining years in paaco and plenty, enjoying tne 261 gs0d things of this life—on somebody else’s money! Armed with this informatlon, Mr, Martin communicated with Sheriff Mil- lex of this couaty, who took proper stops to secare thls plnk of propriety to answer Justice Andereon {ssued hls warrant yesterday, and learning of Stolle's whereabouts and arrest by a California officer, in obedience to information from Nebrasks, took steps to eccure the proper requisition for’ him, Stolle wlll so0n bo hera to exchange his dellcacies of diet, on which he has been foasting in the Golden State, for plain home fare with Shoriff Miller in this land of cornbread, hogs and Missourl river water. ESTIMATE OF CITY'S LI\BILITY. A reasonable estimate of the juet Jia- bility of the city, ia all cases now pend- ing, would not probably excaed the sum of $20,000. What amount of judgments will be rendered can only be determined a8 tho cases are reached for trlal. Asa rale, courts and juries are disposed to deal fairly with the clty, and to repudi- ate, when the evidence 80 requires, the many groundless actions which 20 fre- quently have been sommercad withous reference to either law or justice. BEWER TAX CASES, As will ba observed from the list of cates pending, there cre fifty-one cases of tto entlre number commencad, to re- cover sewer taxes paid under protest, amoanting to the sam of $19,423.42, It is probable that these cases will be ad- justed sutisfactory to the city, and to the perties plalntiff, By rzason of the un- constitntionality of that provision of that charter, which required that the arses: ment of taxes to cover the cost of sawers, should be according t> valuation, in place of epecial benefite, the taxes levied were pald under protest, and - sulls commenced to recover back the amount of such payments. The law has since been amended, and speclal anthority given to ths mayor and council to make a re-assessment of such coat, which will probably bo don ia the near future. As it is claimed that the cost of certaln mains was included in the origlial astesement, when tho cost of such mains should have been borne by the city at large, which claim would ap- pear jatt and correct; it is probable that such cost will bo deducted from the amount of the future levy, and that the taxes as re-asseszed, will at once be set- tled,and the suifs now pending dismissed.
