I atopped and offered to asist him. Just then Dr. Cross drove past. McKune said: “That man fears neither God nor man.” That if a wolf and Crow were at large and both wers to be shot, he thought the man ought to be shot first. He said something about Cro’s belpg “a mean man,” 1 can't glve exact words used. I did not use the word “'shoot” till after Judge Hubbard sug- goated It. JAMES MATHISON 7. F. It waswhile the fair was in progress. Soon after the clock struck 6 I was standing on the side- walk waiting for Jones, That was the evening Dr. McKone was killed. From where I stcod I could look along Firat avenue and my view was unobstructed. I saw a man croes Pearl street and follow a man who had ¢ome sround Woodbury's corner, going west. The man who was shead did not look back, The man be- hind was on “‘kind of a dog trot.” He caught up with him between the firat and second tree. Then the rear man struck the other in the back of his head with his left hand. When he struck this blow they were necar the building. He was right behind him when he struck the blow. The head man c>uld not see him; the head man did not fall, he only stag- gered. Then he struck him agaln; struck him In the face. Then there was a strug- gle; blows passing. The next thing was a plstol shot; Isaw the smoke, but did not ece the man fall, They were olinched, and the rear man had the other by the coat collar;'I think bearivg him down. As the strugglo advanced the parties moved to the westward slightly. At the tima the shot was fired both were on the walk, The red-whiskered man was fac- ing me; the other's back was toward me at the time the shot was fired. Dr. Cross made no such statements as defailed by her. Three or four times at our house my hus- band was weraedto be on his guard. Mrs, Ballard sald he was a very bad man; that the doctor shonld be careful and take cara of himself. That he was liable to ba attacked at any fime. I went to the jail the next day after the doctor's arrest. I was born in Baltimora forty-two years sgo, I re- moved to Council Blutfs in 1879, where I have sinee resided. I remember the time 1 killed Dr. McKune. I was out in the yard with my wife, He talked a few minutes with Mrs, Horton. My wife wanted some meat for the doge. 1 went to Sackett’s but did not enter. I met him and Mra. Sargent. I met my boy at the corner. I sent him to the postoffice to get change. I passed a lady on the croseing. I was golng west, near the corner of Woodbury’s. I heard some ons coming up quickly behind me and then I recelved a terrible blow from be- hind and I nearly fell. He struck me again several blows, then he took me by the throat and gald: “I'll kill you now, you s—o—a—b—h.” Imanaged toget out my revolver. He loosened his grip on my throst and we began a straggle for the possesslon of the revolver. I suc ceeded in turning the revolver toward him and pulled the trigger. He fell. Sargeant came upand asked me what was the matter. 1 said, **This scoundrel struck me down from behind and 1 had to kill him to save my life,” Then I went to my office and fainted. The officers soon came in. There was a lump back of my lefcear. The bone of my nose was broken. The wound on my hand was dressed and I went to jall. When he had me by the throat I did the best I could to loosen_ his hold. 1 was near the second {ree when he struck the first blow. It was near the crossing back of the office where the shot was fired. He was on the outeide of the walk; I on the inside, next to the fence. When we were struggling for the posses- sion of the plstol he was a little to the west of me. The pistol was turned toward me, and In the stroggle I succeed- ed In turniog it toward him and fired. I was dazed by the blows and choking, and can’t tell ust how long the actual con- fllct lasted. In December, 1880, we had some tronble about the Dellah Nichclson case. met McKune, in December; 18580; we walked a short distance together near the Northwestern depot. He said: *‘If I have any trouble about this matter (the Nicholson difficulty) I will make a sud- den ending to your practice in Council Bluffs.” He ehook his fist at me; his face was very red; the velns of his neck stood ont, 1 was introduced to McKune at the art exhibition some time after I arrlved at the Bloffe. Our relations up to the time of the Nicholson trouble were friendly. After that he scowled at me when he passed me, A short time before the tragedy he ehook his fist at me and cursed me, The day I killed him he patsed me oa the street. He scowled atms and struck sagaintt me as wo passed. That was the last time 1 saw him until. the final struggle. 1 heard the testimony of A. B. Nicho- las yesterday. 1 made no threats against McKane in his store or in his preeence. We did have sgme talk about the abortion cage. He eald McKune might injure me. I sald if he attacked me I would try to defend myself, I made no threats against McKune in Mra. Ballard’s presence as detailed by her yeetorday.
