From thess objectlons It appears that the deceased was, at the time of his death, upwards of 70 yoars of sge, and that during his last illncas, about ten days before his death, he made a will glving his property, amounting to about $5,000, to hls wife and gon Robert, leavlog the other child- ren without any Inheritance. 1t ls clalmed that the others had been given some portion during their lifetime, ex- cept one*daughter, Mrs. Maxley, who filed the objections. It appears that she had _recsived €500 from her father on condition that she should pay him 10 per cent Interest on it during his litetime, and at his death the money should be hers. In making this arrangement she gave her promissory note for thisamount. Instead of having this amount given her In the will, she was not remembered, and the note stood out against her, and the other heirswould not allow it to her. She therefore ob- jects to the will being admitted to pro- bate, claiming that the old man when he made the will was so affected by the dls- ease and by the medlcines that he wes not in mental condition to make a will intelligent'y. Somc witnesses testifivd in support of this claim, it appearing that the old gentleman was in such a stupor that he had to be roused from time to t!me In maklng the will, and that he was wancering in his mind and ram- bling in his talk atthe time.
