Dr. Cross Gets & Change of Venne Ater @ Herd Fight, Too Much Feeling Agalnst Here, Him Most of the time in the district court yostorday was spent in sparring about the case of Dr, Cross for the killlng of Dr. McKune. The attorneys for the de- fenso presented a motion for a change of venue, based on the claim that thera was too much prejudice against Dr, Cross in this county for him tojsecure a fair trial here. All claim of prejudice on the part of the judge was withdrawn, the claim belng againat the people only. In support of this were the affidavits of the attorneye, also of the defendant and of about eight citizens. Theso affidavits set forth the reasons of their belief that there was too much prejudice here. On the other hand the state disputed this claim and presented the aflidavits of about a hundred citlzens, claiming that no such prejudice existed here. In the afternoon Judge Loofbourow was to give his decision and a large crowd gathered to hetr it., The defense filed another aflidavit olalming that seven or eight of those who had signed affidavits for the prosccution had said that thoy were anxious to have Dr. Cress tried here, and it they could geton the jury they would convlet him, The pros- ecution wanted to have the defense file & more specific affidavlt, naming the per* sons referred to, so that they conld rebut the charge, but the judge declared that he would not compel them to do so. In regard to the motion for a change of venue the judge declded to grant it, and ordered the case sent to Mills county. The term there opens seven weeks from now, so that the defense practically gets ita continuance and change of venue both. Mr. Haldene, who has appeared for tha defense in the absence of the other coun- sel, has showed more than ordinary skill and shrewdness in the legal sparring which has occupled the past fow days, and many words of praise we've heard from members of the bar and lookers on, even among those who are not specially in favor of Dr. Cross. The stato was rep- resented by a formidable array, Col. Sapp, N. M. Pusey and Col. Dally, being as strong a trio as could well be selected. e — McClurg’s relf-rising buckwheat flour is the best. It Sceks Relief From Its Troubles by Disbanding, The Baptist church society has been in much trouble for a yearor more past, mainly on account of dissensions caused by some desiring Rev. Mr. Lemen to re- main as Its pastor and others desiring him to go. The management of affairs has been evidently very bad, judging from the result, for the church finds it. self in a deplorable condition now. Asa relief from its troubles the church has decided to disband its organization, and turn over its property to the Home Mls- sion soclety of New York, who will pay off the liabilities nmnnngg to be- tween $200 and 00, and take the property, with the understanding that when a new Babtist ghurchi’s orgunized the mission society will deed the property to the new organ- ization on payment of the money ad- vanced, with interest. Rev. Mr. Proper of Des Moines, ie here and will hold eve- ning payer mestings, and preaching ser- vices next Sunday. and see if something cannot be done to harmonize the various interests, and strengthen the cause. It is to be hoped that from out the wreck may be built a strong church yet. ——— H. A.
