The Lovejoy Case to be Given fo the Jury To-day, An Attachment Issued for Mack, the Migsing W tness in the Bribery Oases in the Btate Court, Upon the convening of the district court yesterday morning Judge Neville made an order that an attachment for the body of William Mack, the material witness for the defense in the council- men's briobry cases, bo lssued by the clork, The cause of this order was the statement by Mr. Ambrose, which came to the ears of the court, that Mr, Mack had been seen on the corner of Four- teenth and Douglss yesterdsy morning. As the application for continuancos had been granted by reason of his absence from the city, the court had determined to set them astde in case he could be found, The sheriff, however, was unable to sorve the writ, and these cases being the last to bo tried by a jury the panel was discharged for the term. As 1o cases could be found ready for trial, court adjourned early in the after- noon. It is thought next week will close the present term. & Upon the opening of the United States district court yesterday morning, the roct examination of Peter Schwenck, a witness for the dofense in the Lovejoy opse was resumed, The object of this witnesa's testimony was to show the con- vivial habita of the principal in the bond, and that the government had notlce of hio fraudulent acts for some time before he absconded. Upon cross-examination Schwenck testified that ho was in Wash- ington in June of 1882 on business of his own before the interior department at Washington. In July he satd ho re- turned. Mr., Lambertson then asked him {f he were not the person who came out - to Nebraska after the alleged fraudulent certificate for the purpose of showing what Nebraska's population was in 1870. The witness said he was the person and went back to Washington to attend the meeting of the investigating committee and not for the purpose of looking after the Lovejoy case, [Schwenck, it will be remember s one T'HE OMAHA DAILY BEE--SATURDAY. DIAMOND THIEVES, Yenterday two slick looking fellows en- tered Max Meyeor's store and asked for some unset dismonds, Mr. Julius Meyer produced a paper contalning & number of nice stones and the fellows began to ex- amine them. One cf the fellows pre tended to be very near sighted and got down very close to the paper. His nose touched the paper and he hurriedly slipped out his handkerchlef and wiped his_smeller, Just before he puthis handkerchief over his nose Julius saw something sparkle and oailing him took from him a fine stone which he had concealed in his “‘wipe.” It then was discovered that he had a little pleco of wax on the eud of his nose and a8 it tonched the paper oneot thediamonds was ralsed and transferred to the hand- kerchief. He raised the window on the the Ninth street side and saw the form of & man upon the iron steps. He at once hastened to the sufferer, dragged him into the hallway and laid him upon a sofa, near & steam radiator, Immediately after the man was placed upon the sofa he expired. . The coroner was notified and the body was removed to the undertaking rooms of Drexel & Maul, where it was ascer- tained that the dead man was J. Henry Hobart, well known to many persons in thia city. The man was poorly clad, having no overcoat, no under clothing, and the clothing which he did have was very light and minus the buttons. Hobart had been greatly addicted to drink for several years and has gone rapldly down the hill. Thursday afterncon Clty Clerk Jewett paid him $6 for services rendered asclerk of election in the Fifth ward at the late election, After Mr. Jewett paid himthe money he remarked that it would prob- ably kill him and sure enough it did. John Edward’s Cottage Partially De- stroyed by Flames. The alarm turned in last night was from box 16, corner of Sixth and Pacific and was caused by the discovery of fire in a story and a helf cottage on the corn- er of Bighth and Pierce. The building had been untenanted for nearly three weeks, and was the property of Mr. John Edwards, of this city. Tho fire was of incendiary origin, and when firat dlscoverod was in the center of the large was drinking last evening and waen that seen was considerably intoxicated. He probably wandered around the atreets, until, overcome by the cold, he sank down upon the ateps and there died. The man was about 44 years of age and was a civil engineer. An inquest will probably be held this morning. J. Henry Hobart was connected with one of the best families In this country and was at one time a very fine civil en- gineer. He was a native of Pennsylva- nia and several years ago went to Califor- nia and entered she employ of the Cali- fornia Southern railroad company. He built what is known as the *“Loop” on that road and it is regarded as a wonder- ful piece of civil engineering, Early in the spring of 1877 he came to Omaha and waa employed as a clerk in one office aboutfour years. He contracted the habit of drinking and neglected his work until he was relieved from duty.
