What Each Side Has to Say About It, As already stated in Tur Bre the democratic committee of this judicial district is urging that Judge Aylesworth should contest the election of the repub- lican candidate, Judge Loofbourow, snd appointed a committee to wait upon Judge Locfborow and ascertain If he would not agree to some statoment of facts, to be presented and passed upon by a court of contest, without going into the troublesome work of Introducing witnesses and fighting every bit of testi- mony, word by word. The committee has waited upon Judge Loofbourew and laid the matter before him, but did not press for an immediate reply, courteously conceding that he would naturally want a littlo time to think the matter over. The committee got no definite reply to the proposition, but got intimations that did not awaken much hope for a fa- THE DAILY BEE COUNCIL BLUFFS vorable reply, when it should come, OF course Judge Loofbourow is not axious for n contest. Ho is declared elected. 1t ia the other side that is anxious. As to the proposition made him to agree on some statement of facts to present for court of cqntest, it is underatood that he looks wpon the proposition as absurd. The situation to his mind seems to be in substance that alla court of contest would pass upon would be which candi- date roally had the most votes, T agroe on a statement of facts would thererore bo to agree upon which candidate had the most votes, gand if an agreement was reached on this there would be no need of a court of contest. The contest seems to bo really on the corrected returns of Green county, by which & majoritycf 19is fizured out in Judge Loofbourow's favor. He and his friendo say that to agree that he did not receive these votes, would be to agree that Judge Aylesworth wae elected, and thence no court of contest would bs neoded, To agree that Judge Loofbourow did really recoive these votes would also do away with the necesslty of a contest. On the other hand Judge Aylesworth and his friends put it thus: The ques- tion is not: ‘‘Didjthe parties who opened the ballot boxes, days after the election, ning, Music and dancing, ladies admitt- [in Grant, Scranton, and Jefferson ed free. townships, in Greene county actually change or substitute The basement and parlors of the Broad- | hailota?” The real question is way Methodlst church are being repaiute« ed and refitted. In other words they want the court of contest to simply review the action of the board. Both sides agree that they do not wish to’enter a contest where there will be a hunt after illegal votes. Such a contest, however, It might result, would be un- satlsfactory, orit would be simply the question of which party could do the best hunting, and get the largest number of oases. “Judge Aylesworth himself does not seem anxlous for any contest, but the apxiety seems more on the part of those who have an Interest In having Judge Aylesworth vacate the superior bench so a8 to give a chance for some other dem- ocrat o rise. —— Ask your grocer for McClurg’s self- ralsing buckwheat.
