Banker Commings' Marderer Exconted at Nevada City, Cal, The Robbery of the Eareka Stage Trailing the Road Agents Story of the Orime, Nevana Ciry, Cav., February 1.—John C. P, Oollins, alias Patterson, was oxc cuted here to-day for the murder of Bank or Cummings, in . The hanging took place in the jail yard, in the presence of a large crowd, during a heavy rain-storm, Collins was game to the end, and per- sisted in declaring his innocence of the crimo for which he suffered the death penalty, His pulse beat only 11 min- utes after the drop fell. THE STORY OP THE CRIME, The crime for which Collins suffered the death penalty to-day was committed on September 1,1879, ~On that day the Eureka stage, which ran from Moore's Flat to Nevada City, Cal.,, was stoppad by two masked men at a lonely part of the road about three miles from Nevada City. Thero wasa full complement of passengers. On the box-seat with tho driver was William F, Cummings, a bank- er of Moore's Flat, and a female school teacher. Inside there were three men, a women with her three children, and a Chinaman, All those on the stage, ex- cept tho driver and the school teachor, were made to come down in ths middle of the road and stand in a row with their hands up. One of the highwaymen, who was afterward proved to bo Dorsey, now serving a life term in San Quentin, searched the passengers, while the other —Patterson, alins Collins—stood guard with a double-barreled shotgun. The passengers made no resistence, but the banker Cummings was not searched. Then the highwaymen went for the mail and express matter. The last thing he hauled out of the stage boat was a heavy valise, THE MURDER OF CUMMINGS, When Cummings caught sight of this, which was his own valise, and contained old-time fire and life which have won for her the plaudits of the world. One can scarcely realize, as sho appoars before tho footlights in stage dross, that she is an elderly lady, and yet a close inspection of | her features reveals the fact that Fathoer Time has been lingering around her. More partionlarly is this noticeable in her votce, which, at times, c¢racks and grows hoarse. In the first twoacts of last night's play the audience were unusually cold, and it required & mighty effort to arouse them from tiio lethasgy into which they had coemingly fallen, At the close of the socond «wct, however, they became warmed up end called Miss Mitchell before the cuttain, From this on they were more enthusiastic, and at the close of the third act the little favorite was again asked to step bofore the curtain, The company supporting Miss Michell as ““Mignon” are very olover throughout. B. R. Graham’s *Wilhelm Meistor’ was well rendored, and at times his acting was cxcellont, Misa Lizzie Goode, as *‘Philina,” was not only a good actress, but was favored with a beautiful form and face, which mado a pleasing impres- #lon upon the audience. R. I, McClan- nin, as “Sporati,” was very clover, and elicited hearty applause. As usual, about the middle ot the last portions of the audience arose, adjusted their wraps and procoeded to leave the houso, much to_ the annoyance of those who desired to sit the playout. People who pay their money to hear an enter- tainment have a porfoct right to hear it, and no one has any more right to rob them ef that right than to rob them of other rights or proporty. This thing of leaving the theater during the last act has become a nuisance and should be abated. Love, Lunacy and Death, Racixg, Wis,, February 4.—Andrew Johnson, & young Dano, dissipated in his habits and ¢namared with a young girl of 15, named Bertha Drassman, yesterday entered a restaurant where tho latter was employed. The girl, secing him enter the place, romarked, I don’t wan't any- two large gold bars _valued at 87,000, he t Dol sprang forward, clutched it and said: “You wouldn’t take all that a man has in the world, would you?” The stage- robber made no response, but took a firmer hold on the valuable prize. Cum- minga was & powerful man, and the strug- glo between the two was desperate, the self-cocking revolver in the robber's hand being twico discharged, Meanwhile the three men stood in the road like so many statues, and offered no help. At the second shot Cummigs cried out despair- ingly, *Have I no friends here?” and fell, the robber benz on top. Cummings tried to draw his revolver, but the robber got hold of it Then, making a last effort, the wounded man rose to his feet, grasped the weapon of his assailant and was evid- ently geating the better of him, when the second highwayman coolly stepped around from his previous position, took him at Cummings and fired. The heavy charge of the shotgun passed into the thing more to do with you.” Johnson ized the girl by the shoulders, and drawing a rovolver, fired, the shot strik- ing the girl in the breast, and as she turned, shot her again in the back, then put the pistol to his heart, fired and expired instantly, The girl died a fow moments later. On his way to the restaurant Johnson mot a young man named August Gulbranson, fired once at him, the ball going through Gulbranson's pants, but not harming hiw. A lottor found on Johnson's person shows that the crime was premeditated. SR “DRAW" ON THE UNION PACIIIC Four Queens and a Pistol Win a “Jack Pot” and the Game, Chicago Tribune, Licut. Somerville, U. 8. N., who has neck of the unfortunate man, killing him instantly. The robbers then went on with their work of plunder. They got the two gold bars and about $500 in loose coin. They forced thepassengers to get intothe stage, and wera last seen standing by the body of the murdered man. ON THE ROBBERS’ TRAIL, Rewards amounting to $5,000 were of- fered for the capture of the stage-robbers, but it was many months before any clew was obtained, 8o skillfully had the high- waymen covered thair tracks, The first clew was gained from a young woman who was staying at Nigger Tent, a noto- rious resort for outlaws in Nevada county, not far from the scene of the crime, This was two months after the murder. She described the appearance of two men who came to the place vn the night of Septem- 1, and were taken in and fed by the hostess, an old woman named Romargie, From the descriptions Detective Hume, of Wells, Fargo & Co., and Capt. Aull, of San Francisco, decided that the men must be Charles Dorsey and John C. Patterson, both ex-convicts. ~Dorsey had been a guerilla in the war in Missouri and Kentucky, and was regarded as the most desperate man in State Prison at the time he was serving his sentence. Patterson was his chum in prison, and their in- timacy led th the suspicion that it was they who had committed the robbery and murder. Wasiineton, February 4.—Represen- tative Morrison completed the tariff bill this morning and during the eall of states introduced it in the house. The bill was prepared last week with the ex- eeption of placing a few articles on the free list, concerning which Morrison wes undecided. A reduction of 20 per cent is made in numerous articles, while in a few cases the reduction is greater or less than the rate. Provisions prevent any reluctions to rate lower than the Morrill act of 1861. The title of the bill reach; photographs of the two men were scattered broadcast over the country, with descriptions of the men and the royal rewards offered, but no trace of the fugitives was gained fora long iime. |f Finally the detectives heard of them in Tombstone and other quarters of Arizona spending money in lavish style, but there sfl clews vauished, FOUND IN 8T, LOUIS, The murder mystery remained un- solved until June 20, 1882, when Detec- tive Hume received a letter from the chief of police of St. Louis, saying he had Pattorson in custody there on a charge of burglu;y. Capt, Aull, with Capt, Lees, of the detective force of this city,went on on’to St.Louis and brought him out here. He was readily identified by two of the | passengers in the coach ad the robber who did the fatal shooting soon after his capture and extradition, Dorsey was caught+in Union City, Ind. 1t seems he was serving out a minor sentence there, and in a burst of confidence one day told a fellow-prisoner the story of the stage robbery, This fellow peeched on him and he was brought out to California. Here he made a slean breast of the whole matter, turning state's evidence to save his neck. He was sent over to San Quentin for life, while Patterson alias been with the Asiatic equadron and is now at the Palmer, on his way to Wash- ington to report for other duty, tells a good story of a confidence game which some sharpors tried to play on himself and a brother officer on the train be- tween Ogden and Omaka, pied the drawing.room of one of the sleepers on the train, and one morning after breakfast were enjoying a cigar when the door opened and o well-dressed per- son appeared, excused himself for taking the liberty, and asked if they would object to aid in making up a friendly game of *‘draw”. They assented; were introduced to the other gentlemen and the game was made up. Nothing un- usual occurred for some time until Lieutenant Somerville opened a *“jack- pot” with an ace-ful pat. He opened it for $26, and one of the strangers drew three cards and raised the lieutenant |2 back after the draw $560. Not feeling certain of his groand the officer called | #oo= and found himself confronted with four deuces. Nothing was said and the game went merrily on. In a little whilean- other *‘jack-pot” came along, and one of the strangers opened the pot for $50. At this the captain (for such was the rank of Somerville's companion) re- marked to the opener of the pot, *‘What do you take me for?" “What do you mean?’ replied the gambler, “‘I mean,” answered the captain, ‘“‘that I have held this hand (exhibiting four queens) four times since this game start- ed. I threw it into the deck three times, but this time I shall play it and win the pot with it."” ““If you caro to knew what I took you ,” answered the gambler, alive o the situation and arming himself with all the assurance he possessed, “I took you for a blank sucker.” “You are a blank liar,” retorted the captain, simultaneously drawing a six- shooter, and I shall pocket this monay, and you had better fork over all you have won pretty quick.” Everybody jumped up, but the captain’s gun commanded the field, and after considerable kicking the professionals disgorged, leaving the naval men winners to theextentof nearly $160, By this time the Pullman conductor had ot posted and brought the train con- uctor on the scene, and the confidence men were put off at Granger, and Lieu- tenant Somerville says that they were about the sickest looking trio he has seen for many a long day.
