Highly Sensational Case From Holt The Grand Lodge will hold _another Connty An Injunction Suit Involving Seventy Thousand Dollars, Decrees Entered in the United States The adjourned term of the United States Court now in session in this city has brought to notice several important cases, one from Holt county being cspec inlly interesting. AN ALLEGED MURDER. Army officers in this department are familiar with the name of Captain A, E. Hooker, of the Ninth Cavalry, whose sud- den death in January last gave rise to some very ugly charges in the courts againat his brother and to no small amount of litigation. Capt. Hooker was married eloven years g0 to & “grass” widow, in San Fratcisco and after living with her for some four years, they finally separated, she going to New York to live, being supported by a monthly allowance from the captain. Her husband is described by those wh knew him as a quiet, intelligent man, who loved to be alone and out of all reach of the bustle and cares of life He bought himself a ranch up in Holt county, which he stocked with cattle and put 1 charge of a man_who lived with his wife in a cottage built forthem, while the Captain erected a small home for himself not far distant and took his meals with them. some time previous to Januaty 20th he obtained a leave of absence and went to reside on the ranch for a time. On the Oth he wrote his wife from Chicago, and the next news she received from him was a dispatch announcing his death on the 20th of tho same month. Mra. tlookoer at once came to Nebraska but did not arrive until after the remains had been interred at Fort Randall. 1t was claimed that an the morning of the 20th, the captain went to his break- fast os well usual and an hour later was taken with spasms and expired at 2 o'clock p. m. A post mortem was held but nothing reported at the time as tending to indicate foul play. Upon the arrival of Mrs. Hooker she aid claim to a herd of 400 head of eattlo, which was also claimed by Judge Hooke of Holt county, a brother of the deceased. An administrator woa appointed and the [ cattle were replovined, but as no bond vvas given they were returned to him and & new suit of replevin commenced by the w in the United States Court at this city. As a matter of fact the cattle never actually chanzed hands, having previ- ously been soid to Hon. Wm. A. Paxton, of thia city, and out of this two suits are now pending in the district court of Douglas county. Pending the litigation in Holt county, Mrs. Hooker brought the serious charge that her husband had been poisoned, the body was exhumed and a new post mor- tem held, fhe result of which, it was claimed, was the discovery of strychnine in the stomach. Mrs, Hooker next had Judge Hooker arrested ior murder, but he was at oncefbailed out by friends who scouted the idea of such a thing being true. The case was investi- failed te find an indictment and now it only remains to settle the civil cases. The replevin suit in the U. An important land case was tried Wed- nesday before Judge Neville and a jury, it being the first of a number of similar actions now pending in the District Court, involving title to the entire tract of land near the city, known as Griffen and Smith's addition. The land was originally entered and patonted by Jane A. North, mother of James E. North, the plaintiff, soon after obtaining the patent. Mrs. North conveyed the land to her son, who was then a minor, and who, during his minority, re-conveyed the land to one Augustus Giraeter, Jr., as is claimed, to be held by said Gracter in trust for said minor. While the title was in the name of Augustus Greater, Jr., judgments were obtained against one A. F. Graton, and the land in question was sold by the heriff to satisfy such judgments. ~The parties holding lots under conveyances made by Griffen and Smith, claim under the Sheriff’s deed while Mr. North, the plaintiff in the several actions, claims that the Sherif’s deed conveyed no title, as the judgmonts were not against the identical Graeter who held the title, and oven if they were, he had no interest sub- ject to levy and sale, as the conveyance to him was the act of a minor, and created merely a trust. After beceming of age, Mr North put upon the records a disaflirmance of his action in making deed to grantor of land, and now claims he i possessed of the absolute title.
