Two Mothers Fighting for Their Own Flesh and Blood. “Little Jay’' Disposed of at Last—-The Kelly Uase in Oourt, Yonterday afternoon both the couaty and distriot court rooms were the scene of sensational cases, THE KELLY CASE which has been pretty well advertised in the papers has at length got finto the courts, and an esrly solution of the queation of which of John Kelly's expected, Mrs. Kelly who came out from Philadelphia to get her two girls, msecured the services of Judge Van Eiten, and yesterday afternoon a writ of ha- beas corpus was sworn out before Judge Ohadwick, and placed in the hands of Deputy Sheriff Crowell and Oonstable E ’gerton for service. They proceeded to the residence of Mrs, Kelly No. 2, in North Omaha, and tound that lady out, but the eldest gir), Alice, was at home, and Jane was at the house of a family named Clalr, not far away. The two young ladles were taken in custody, and brought before the county judge, where thelr alleged mother soon appeared to fight for thelr retentlon, General Cowin had been engaged by her to conduct her ocase, and as he was not able to b prosent, owlng to the fact that he was similarly engaged in the distriot court, the hearing was post- ;onod untll Monday at 2 o'clock. t was a question what was to be done with the two girla in the meantime and it was finally decided to tnrn them over to Mr, Doerr, the expressman, with whom Jane had lived for five years and who is bound to produce them ia court at the time named. It is believed that had Mrs, Kelly No. 2 known of the action being begun the two girls would have disappeared as quickly and mys— terloualy as they did from their old home in Philadelphia. BABY JAY, In the distriot court at 4 o'clock Judge Wakeley heard the argument in the famous case of Kingsley va. Whitman. ‘This is the contest for the possession of the infant left at one of the doors in the clty hall bullding, where it was found by Vanderford, of the fire department, turned over to Mrs, Faller, the clty misslonary, and by her given to Mr. and Mrs, Whit- man, a respectable couple llving out on a farm, to raise. A somewhat sensational case has grown out of the foolish infatuation of John D, Freel, a Burt county far- mer for Jennle Brown, a well known habitae of Tenth street. Freel fell in love with the woman, who has a boy 13 years of age, and made numerous presents to both, and proposed to marry the woman., He came down to Omaha on Thursday and both stopped at the 8t. Charles that night, it being the understanding that they were to go up to his farm yester- ay. Friday morning, however, Jen- nle stepped out ot the hotel with her baggage and disappeaeed from the sight of the anxlous lover. When Mr, Freel found out that she was glving him the shake he brought a sult of replevin to recover the pres- ents he had made the mother and son, Jennle's trank was found and caj tured from its hiding place on the hill at the foot of Dodge street and every- thing was got back exoept the sult of clothes given the boy. A Man Who Clalms to Have Been | Pcst office. Robbed—Minor Matters. About 2 o'clock yesterday aman who gave his name as Charles Jones was arrested in front of the Paxton for Intoxication. After being taken to county jall the prisoner was sgain searched and $10 found ooncealed in the lining of his hat. He probably has the rest salted away somewhere, His story Is doubted by the «ffisers, and they think he will have another term after serving out his present sen- ence, There were four ceses of plain drunk yesterday, two of whom were seat up for 16 days each on bread and water, one ln default of $10 and costs, and the fourth continued.
