Bpecial Dispatch to Tas Bas, Dur:in, April 10,.—The trial of Joe Brady oun the charge of murdering Oavendlsh and Barke, was begun this morniog. Notwithstanding the fact that It was known that all absentees would be fined £100, many jarors on the panel failed to appear. The caze for the orown was opened by Porter. Dusuin, April 11.—Porter, crown counsel, in opening, described the Phee aix park orime as of unparaleled atrocity--a orime that had shooked the whole olvilized world. He re- counted with vivid imagery the well known detalls of the affalr, pald a ‘warm tributa to the character and life of Barke and Oavendish, gave partic- alars of the urganization of the In. vincibles who, he said, doubtless look- ed upon themselves as an invincible band, but the law was stronger than all those connected with the plot and looked upon them as gullty in the es of God, as was Brady. He do- ared the objeot of the conepiracy was to ‘‘remove” all whom they regarded as tyrants, probably with the ultimate purpose of forming a republio, of whicu the four original leaders of the marderons garg, Mullet, McOaffeey, Carley and Carey would be the lead: ing spirite. He referred to Sheridan’s share In the crime, his undertaking to provido arms when there should be a call for them. Brady and men of his class wera among those always pre- pared for murder, but they were with- out doubt entirely indifferent as to the ultimate objects of that murder. Brady was at hand when the various ambuakes were lald for Forster. BeruN, April 11 — Sandtmann, progresrist member of the reichstag, repreeenting Hamburg, committed suicide. H:s mind was affected by reverses in business, Sandtmann re- cently loat large sums by the action of the reichstag in regard to the pro- tectlve daty on tobacco. It is raported & new church bill will be submitted to the diet removing re- strictions on the ocelebration of the mass aud administration of the sacra- mente. It is declared also that no such bill is contemplated, although Bismarck mag have privately favored granting Jiberty of worship. Owing to the more genial weather the health 'of Bismarck is greatly improved. Vica-Admiral Von Batach was so bitterly disappointed at the fallure to recelve the appointment of head of the admiralty that he has declded to re- rejudice the jury against the prisoner, Erfi’dy, by making asseriions like these, which oould not be proved. The judge refused to interfore. Porter, concluding, declared Onr? would be put upon the witness stand, There was uo absolu‘e rule of law which would prevent the court from accepting his evidence nnaccompanied by any other testimony, but vhere ocertainly conld be no valid objection when, as would happen ia the presont oase, there would be produced con clusive and corroborating evidence to fortity Carey's. This ocase should teach one lesson, that there counld be 39 honor among membars of such so- eiety. The men whohad instigated it and warmed it Into life; the men who had supplied it with funds, which en- couraged it to oarry on lts desigos, had flad to foreign lands. If there was any farther proot required of how the oonspirators deserted those un- *lawfully leagued with them it was far- nished by the fact that the crown had even in this case been compelled to provice means for defending Brady from this terrible charge. Tho first witnees catled was Farrell, the informer, who testified at the pre- liminary examination of the prizouers in Kllmalnham court house. He repeated the testimony given at that time, Dariog the examination of Farrell, ocounsel, for the prisoner agaln pro- tested agalns: the introdustion of matters forelgn to the present charges relatiug onlv to attempts made agalnat the life of ¥orater. Jodge O'Brlen said only such evi- dence was admissible in the present case as tended to conneot the prisoner with conspiracy. Farrell's eyidence went to show that Brady was asscolated with members of the inner clrole and was secretary to Oarley, Jawes Carey was the uext witness, and his evidence was the same as be- fore glven, Carey was in the witness box an hour and three quarters. He gave a detalled account of the forma- tlon of the Invincibles, but was not allowed to 50 into the plots against the lives of Forster and Earl Cowper, While Carey was testilylng, Brady followed the evidence closely and frequently sent not s to his solicitora, Carey became perfecily cool ia de- meanor. Towards tho close of his evidence one of the kaives found in Ringlend basin was produced that Carey might identify as the one sap- plled by Sheridan from London, Mur phy, crown counsel, stated that the suthorlties know who No 1 i3, and expected a photograph of this myster fous person would ba produced.
