Hill, of L'ncoln, False and Forged Vouchers Procu NX and Cashed. Tentimony of Merohants and Busis ness Men. The trial of D. G. Hull, lately eus- todisn of the government building at Linooln, commenced Monday in the United Statos distriet court, Judge Foster, of Kansas, prosiding in place of Judge Dundy, the regular ccoupant of the bench. The charge against Hull is presenting falee vouchers to the government at Washington, while custodian, and obtaining the money on them, the amount involved and said to have been thus fraudulently obtained by him betng between $5,000 and $6,000. This is alleged to have been dona by felsely representing to tho dapart. ment that supplies for the Lineoln building had been purchssed in excess of the actunl amount, and tho money thus received being pocketed by the accueed, The witnessen for the government number about twenty, and they were in attendance vpon the opening of the oane. The prisoner is well ropresentad by two able attorneys of this city, ands) far am the trial has already progressed it is apparent that a strenuonuns effort will be made to avert a conviction, Hull presented himself in court and dnring the proceedings sat near his oonsel giving them instractions when he thought necessary snd otherwise supervising its conduct. After the jory had been swora the first witneas, Mr, Swords, of the treasury depart- ment, was called, and testified that he had worked up the case, and concern. ing other prelimi;ary mat‘ers, J. H, Harley, a druggiat, of Lin. ooln, testified that a voucher purport- ing to ba for five gallons of alcohol furnished by him was incoricet, He had furniched Hull bat ono gallon, and that had been charged to Hull as an individual, snd not to the govern ment, Ho atated thathe had signed the voucher at Hull's request, end that the voucher waa in blonk. R. D Stearns, Holl's law partner, was next examined. Ho teatified that vouchers which purported to be for furnishing tho building with twenty- four arm chairs, at $168 25; one hun. dred and twonty-five yards of malting at $119, and a wardrobe for $45 oy himself were false. He had never de- livered the articles. He had signed the vouchers in blank at Hull’s ra quest, He had made somo excase to wituess which had induced him to do #0. Hohad not even seon the face of the drafts roceived in payment when he endorsed them, Hull atating to him at the time that the mento whom the nccounts wers due were out of r. Kinney, the deput; ntmaster of Linooln, teatified thitpahe had signed vouchers in a similar way for lowing, harrowing, seed and manure, n all $120. He had never received any money nor had done eny of the work or furnished any of the material et forth in the vouchers. He had o signed the drafts on the back and had not seen their face Mr. Meyer, a grocer and dry goods dealer, awore that hoe had furnished a doren towels for 811 or $12 and had signed a voucher which, when presen. ted In evidence, called for $18, which amount had been paid by the govern- ment, The whole session of the court yes- terday waa devoted to the hearing of evidence, Hull, as on Monday, was in the roem during the entire day and seemed & littlo more nervous than the day before, although his equanimity was well preserved and he laughed and chatted with friends during the progress of the caro when not ocoupind iu Jistening to the eviderce as it was brought cut by the uttorneys. . M. Davis, a carpet dealer of Lincoln, testified that & voucher was offered in evidenco for putting down carpets in the building the amount of which was $114. Witness testified that he had never put down any car- pots for Hull and never had received a cent from him, man named Brady, a carpet Iayer, was called and testified that he had helped put down the carpets when they were Iaid and had received $17 in payment for his work. He had signed a voucher for $34 The next witness was H. Downs, the bookkeeper for a coal firm ia Lin- coln—A. D, Marshall & Co, Mar- shall, the senior member of the firm, was dead. Tho witness tesiibad that & number of vouchers shown him by Mr, Lambertson, the Unit:d Siates attornoy, for cosl alleged to have been furnished by Marshall & Co. were all incorrect, The first ono was for $1,280. This conl had never been furnished at all, Avother voucher supposed to represent the value of coal to the amount of §1,726 was false. The witress stated that coal in this ivstance nad baen deliverod amounting to §7260, but no more, Another voucher shown witness ealled for 135 tons of coal and was valued ut $1,765. He said that in that case only 114 tons hsd been sctually de- livered and it was valued at §1,540, instead of §1,766, J. 0. McBride, the Lincoln t master, wus the next witnoss called. An examination bearing on a voucher for 8627 for coal, and made out by Hull but certified by MoBride, was commenced, but the attorneys for the defense objected, a wrangie ensued between the opposing counsel which terminated by the judge deciding that MoBride's evidenco would not be ad- mitted on this pout, The reason was because the voucher had been made out by Hull, aud that therefor Me Bride's evidence was not the best evi- dence. The witness was excused, but the point most desired by the prose- cution, namely, that the smount had been colleol The voucher made out by Hull wes brought out. No had been delivered for this voucher, W. H, Alexander,s furniture dealer, testified thal he had signed & number of vouchers in blank, but had deliv- srod no gor ds ncr received any money. George Vallery, a clerk for A, D. Marshall & Co., testified as to the amount of coal actuslly delivered to the government building. J. T. Littell, n clork in the treasury department, testitied that he was con nected with the fuol, light, water and farniture division. He had haudled tho alloged fraudulet vouehers during hia work in the department, and rec- ognized them s Hull's, Court acjourned until 9:30 this moraing. b WILL POWER, Tho Sympathy Which 18 Due to the Drunkard. To the Ealtor of Tua Bua. With your permission 1 would like to ask the editor of the only religions newspaper in Omaha by what authori- ty he makes the following statement, which appeared in Sunday morning’s issue! “Tho drunkard who is power- less to control hisown appetite,” This I think is not very consistant the fandamental principlea of religion, as taught by the great loaders of Ieracl or by the foreruaner of Jesus Christ and his dissiplee.” Keep the com- mandments, Roepentye of your eins. Lend a new life. Do unto others as you would haye them do unto you. Love your neighbor ws youresif, and you shall be made heirs of eternal life, Does any sano man doubt for onemin- ute, but that our Creatcr knew he had endowed every man With a will power strong enough to resist temptation, or he would have made some exceplions in his diyine law to ¢ne human race Of course the argument might be used that Adam would not have sinaed if he had possessed the will power to resist, and the fact that he as the rep- resentative of the beginuing of the human race did sin, proves that we do not possess the power to resist the tempter. Thir, however, in my opin- ion, is a very poor argument, because experionce or precedents ought to be the final tribunsl in & moral atatus, just as they sroin a legal status, and it weoms to mo that we ought not to punish crimes at all, if 1t can be proven that mea as & race do not pos- sess the power of self-control. We know, however, that law—the fear of speedy punishment—dois have an effect over thozo who would commit crimes greater than drankenncss. The great religious editor, therefore, is miataken, when he says that society has no mercy for a drunkard. Ifhe had said for a drunkard without money, I might have agreed with him; but as a matter facr, a firet class dravkard or tipler can impoverish his family, botray the confidence of all who trust him; aye, oven whip his faithful wife, aud what is the penalty? Five dollars and costs for whipping his wife. The common Thou shalt not kill, thou shal: not steal, thou shalt not bear false witness, do unto others as you would have them do unto you, e'c, has never boen attacked by tho most ekeptical, and this religion has ad- vanced step by step until nearly every nation bows the knee at itssaered alter, and every Christian heart is full of sympathy and brotherly love. There is no doubt bat that this sym. pathetic feeling which is so easily sroused has been most frequently im- posed upon by drunkards, the most selfish of men, and I think the time has come when we, as Christian peo- ple, should refuse to educate our chil- dren with the money accumulated from finesimposed upon intoxication, and use it for the purpose of building an inebriate asylumor workshop. This then is the way I think our sympathy ought to be shown towards the poor drupkard. Tax-PAYER. ———e— New Year’s Reception.
