Galveston (Texas) Nows Judge Hancock does not credit tho assertion that there are 7,000,000 sheep in Texas, and thinks there are scarcely 3,000,000, In January, 1879, thero wero 2,664,382 head assessed for taxation; in 1880, at the same in 1881, January 1, according to the assesaors’ rolis, there were 3,262,104 head, and it is probable thet the as- sessmont for January 1, 1882, will show 4,000,000 head, and by January next a much larger number will be shown, as the natural increase and the increase by importation from other states would swell the figure probably to 5,000,000 head. But it is reasonable to infer that there is a large percentage of sheep in the etate not on the assessors’ rolls, as is Jhe case with all classes of personal prop- erty. Since Jauuary 1, 1881, when 3,262,104 head of shoep were assessed, very large numbers have been brought to Texas by rail from the older states, and large hercs bave been driven here overland from California and the states of Mexico. The estimate of tho Nows was based upon the natural increase, which is very great, the ex- traordinary impetus given to the busi- ness recently, which has caused the large importations indicated, and the fact, which will hardly be disputed, that a large proportiou of the sheep in Texas are not asaessed. A singular will case, involving con. siderable money and several people well known in this community, came up to-day in the supreme court, On April 8th, 18069, John Hardy and Mary M. S:aith were united 1w mar- riage, and lived together until about May 1lth, 1877, Early in April, 1877, Mrs. Hardy informed her hus- band tuat she desired to separate from him and obtain & divorce, in order that she might marry Kzra G, Perkine; Mr. Hardy was unwilling to assent to tho prop. osition, but at last, feeling compellcd by force of circumstances, did ¢ nsent to certain proceedings being taken to onable Mrs, Hardy to obtain a divorce, At this time they had accumulated a coneiderable amount of property, and lived together at No. 4 Concord square, Mra, Hardy being well known in the community a8 a medium, and Mr. Hardy pursued the buiness of a painter, the earnings of both being allowed to accumulate for thelr joint benefit. \ It was finally agreed that sho might apply for and obtain a divorce, and to allow this plan to ba carried out Mr, Hardy coneented to put himself in a position to allow evidence of adultery to bg presented against him, although ho Was not guilty of that offonse, The consideration for such action on the part of Mr. Hardy was §5,000, which was paid him, and accoraingly Mrs Hardy made application to the pro- bate court of Salt Lake, in Utah, and on the 24th of April a divorce was granted to her. The marriage of Mr. Perkins then took place, and it is claimed that Mr. Perkins was cog- nizant of all the fraud which was per- petrated upon the court in Utah, which, it is claimed, had no jurisdic- tion over the parties or the cause. On the other hand, counsel for the estate of Mr. Perkins contend that Mr. Hardy consented in writing to the divorce, and that, thereforo, he is barred in setting up the divorce as entitling him to a share tn Mr. Per. kins’ estate, The main point at ieane is a clause in the will: *'I will leave to my husband,” otc, under which clause it is claimed that Hardy was her lawful husband, and is entitled to the property.
