The Case Q@iven to the Jury- Prorpects for Conviction, For several days past the time of the district court has been occupied 1n hearing the case of the State vs, Flint- well, Dawson and McDonald, indicted | for robbery committed on the night of the tragic shooting of Si soldier, near Florence. It will be remerabered that the fist act of the spree w the shooting, was the robbery of Levi F. Lewin, who subsequontly identified | the parties and became an imoortant witners for the State. On the trial Lowin testified that cn the 19:h of August, while walking on the road leading from the barracks to Florence, he was ansaulted about half way between the two places by four soldiers, who robbed him of §6 in silver, two pocket knives and a pint der, the culminated 1n ! He says the men told him that they were soldiers, but highwaymen, After the robbery he went on up i5 Florence, where a dance was in progress, and there reported the alleged robbery. A few moments later information camo to the effect that abort a mile and a half down the road asoldier had been shot by some parties in & wagon, whom he ;had halted and demand- ed their money or their brains, Lewin went with the crowd to the spot and identiticd the dead soldier, Shrader, and Flint- woll, who was with him, The latter was arrested at once, and subsequent- ly Dawson and McDonald, the two other soldiers, were arrested at tho barracks as accomplices, In the trial the defendants claimed they were only out on asort of a spree and were going to the danco at Flor- encs. They denied having robbed any one, Flintwell claima that he and Shrader were s0 much under the influence of liquor that the others left them before the wagon drove up and that when Shroder called out: ‘‘Your money or your brains,” ho (Flintwell) called to those in the wagon ‘‘Hold on there that man's drunk,” just as the fatal shot was The State has made a pretty strong case against the defendants and it looked as if a verdict of conviction would result, % Mossrs, Bartlett a~d Peckham con- ducted the defense with ability and Mr. N.
