The City Reaping the Results of the Careless Handling of Small Pcx, Yesterday four more cuses of small pox were reported, they being in the fawily named Cole, living near the 8t. Joe depot, The flag was hung eut, and the place quarantined, The oarelessness with which small pox 'ias been treated here is cousing the dis- ©asv to linger along during these sum- mer months, with cases constantly on hand, so that there is seed for a fur- ther harvest next winter, unless more effectual steps are taken to stamp it eut than have been taken in the past. The quarantines established at different places have been more in form than in fact. There has been slowness in re- porting and caring for cases, and carelessnossin watching those who have been placed in quarantine or the pest house. The small-pox patient, W, W, Wert, who was lately removed to the pest house, is said to have partially exposed a number, he having got far along with the disease before he was reported and taken away from Luis boarding house, It is said he was coming down with the disease while in Ogden, and he was compelled to leave there aud after coming here was in one boarding house for a time before going to the one from which he was removed, and that all of this time he ought to have been in quarantine. 1t 18 expected that some other cases will arise from this exposure. Tyson was clear enough in his swearing, but Burns did not know beer from whisky or ginger ale, The defense claimed that the council had no right to pass a probibitory ordinance forthe real purpose of licensing, but the court intimated that this was a fact which would have to be proved first and considered afterwards Backus was found guilty and was fined $26 and costs, the latter amounting to $1070. He was quite indignant at this finding and refused to pay, and waa sent to jail for twenty-four days. He had locked up the house before coming into court, and as he wended his way to Shantz’ quarters at the court house, he sent word not to have the house opened or boarders admit- ted until he was released. He will probably, on further reflection; con- clude it better to submit and pay the bill. Thursday, Chatley Smith and Wesley Do Spain, two young men from near this place, who had gone out to hunt horses, and also to look for Jim, were at the Cholo atation. While sitting at the camp of John Yeager resting, they saw a man passing along the top of the brushy ridge near the depot. They at once mounted and started toward him, When they came up within speaking distance Charley Smith says he inten- ded to engage him in coaversation un- til he was satisfied that he was the right man. But ‘“‘California Jim” was too desperate to take any chances, and when Smith and De Spain were within thirty yards of him ke drew hie revolver, turned and be- gan firing on them. At the firat or se-ond fire De Spain was struck in the side, the ball passing out near the spine, and his horse threw him. Obarlie Smith dismounted and drew gun and returned the fire, shooting three times. Ono shot struck Jim at the joint of the hip, crushing the bone, presing on through his bowele, rang- g up, and lodging against the skin on the other si Jim foll, but rose to a sitting position and fired again at Charlie, who was stooping with his gun drawn, This ehot struck Charlie just below the knee, ranging up through the fleshy part of tne leg, and entoring his breast. By this time 1| Jim had stopped firing and was down. ,| Charlie then started for the station house, On his way he met the Moxi can hande, who helpsd him to reach tho house, “California Jim” lingered in great agony until 8 o'clock in the morning, and was game to_tho last. No pain seemed to move him, and, when told ke was dying, he said that it was “all right.” During the night ho often spoke tenderly of “Molly,” and the last words we 1 ray “Well, Molly, i or Jim stated before he died that his real name was John Henry kins, end that he had a brorher living in Neosho, Mo, He also said that there was a reward of 81,000 offered for his capture in Arizona, and that he was wanted in New Mexico.
