COUNCIL BLUFFS, The Trains Have the Right of Way at Their Own Speed, | Paving the Streets One of the Great Wants of the Present. Proceedings of the Board of Education Meeting Wednes- day Evening. The supreme court has passed upon the matter of slacking the speed of trains whon coming within the city limits in favor of the railroad corpo- ration. That is, the decision gave the railroad companies within the un- settled limits of a city the same con- sideration the matter of running their®trains as they would be entitlod to when running through any unset- tled country; that an ordinance lim- iting the spoed of trains within the unsettled reasonable restriction upon railroads and an obstruction to public travel. Under the ordinance in question in this case it would take three-quarters of an hour after entering the corpo- rato limits of Council Bluffs to pass over three miles of railroad, through agricultural lands, fenced on both sides, and reach the inhabited portion of the aity, and it would take over an hour and in limits of a city is an un- half to reach the Union Pacific depot. The ordinance places not only an unreasonable restriction npon the railways themselves, but necessarily 1mpedes the whole trav- eling public. Tf all the cities situated along the line of the defendant’s road between Council Bluffs and Chicago should enact and inforce a like ordi- a nance, it is apparent that the time between the two cities would be greatly increased. The erdinance operates as a restraint upon com- merce, and ought not to be sustamed. PAVED STREETS A NECESSITY, The past few days must have the tendency toset citizens thinking of the importance of paved streets. Council Bluffs, above all other con- siderations, needs pavements. Broad- way, Muin and Pearl streets, ought to Le put in a condition to transact busi- ness upon in all kinds of weathor. The fact stares us in the face that after a heavy rain storm it is almost impossible to any very heavy teaming upon them, and the sooner some ac- tion 18 taken in the matter the botter it will be for the city and business, Not a single dollar should be expend- ed in purE- or any other improve- ments ‘until these streets are paved with something suitable to haul heavy loady over. There should be some «definate action taken as soon as the financial condition will warrant it, and all other improvements foregone until it is accomplished, GRADING, The stroet supervisor, while at the work of grading Union avenue, should be instructed to build the same to grade, if not highar. In this event it would serve a double purpose, as a grand thoroughfare to the Union Pa- cific depot, and as a lovee, to keop back the Biz Muddy in times of high water. CATHOLIC FAIR, Next Monday evening the fair to be fiiven under the auspices of the Catho- lic church will open in this city. Among the attractions the first night will be the presentation the interestiug operatta, *“The Fairy Grotto,” by about soventy children, On the second evening, we understand that u dramatic company from Omaha will present the drama entitled, “‘Waiting for the Verdict.” Exten- sive preparations are being made, and the affair promises a good deal of amusement.
