Trial of an Interesting Case from Saline County The United Statos district court has been occupied for two daysin the trial of an_interesting suit, which had its origin in and especially relates to Sa- line county. This case has once before come before the United States cour The action is entitled Cahn vs. Van Duyn ot al., the other dcfendants bein Mesrs. Wehn and Castor, of Wilber, Saline ccunty. Wihn is editor of The Opposition, julished at Wilber, whilo Castor is a prominent democrat, ver 2000 on mortgage which were alleged by Cahn to bo fictitious, the jury failing to agree. The st was brought to re a and note The mortgage'and notes are claimed to have been signed by o man named Gretzel, who bought a farm from Wehn, who has since disappeared. Van Duyn, and who figures as the chief de- fendant, was clerk of the district court in Saline county at the time the notes \d mortgags are allager to have been givon by the missing Gretzel in payment for the farm, while Castor was a netary public who claimed to have witne the signing of the mortgay | After passing from Weln into other hands Cabn, the plamtift’ finally ob- tained poss ssion of the mortgage and notes, and then brought suit against Van Duyn, the clerk ; Wehn, the or- ial owner of the furm, and Cas'or, ihe notary, claiming that these men hnd conspired to issue the securitios itious signaturee, and divided ods of the money obtained from their sale, T'his involved both the reputation of the defendants, as well as the value of the mortgage :nd notes, and they consequently made a vigorous fight on it. The plaintiff alleged as his reason for commencing the action that tho property claimed to be conveyed to the missing Gretzel is not worth the face of the mortgage, to say nothing of the notes. In the former trial of the suit the ue of the farm was variously put at $1,000 to $2,000. 1o the present trial both sides have been ably reprosented by Burr & Webster, of Lincoln, for the plaintiff, and Hastings & McGintie, of Saline county, for the defendauts. The jury will return a sealed vordict to-night if they aro able to agree. The Philomathean Programme. French & Co, t is a well known fact that New York | the | equines bein ;a | tungue Iy in certain portions of that county, and which is death to horses if tuken withio the stomach. This sub- stance Mr. Git describes as re- sembling alkali, but materially differ- ing from itin taste and poisonous effects. The existence of this ma- terial in the soil has been known for sometime, but it hasonly been within the past year that its effects on men has known, among ribed to other causcs, During the past season Mr. Gibble has lost seyeral good horses from this When the second horse was men and le and horses become many the causoe, taken sick, he ascribed the trouble to bots or worms and used remedies for these troubles. Instead of improving, however, the horse continued to suffer some internal trouble, which baffled the skill of veterinary physi- from | cians, and it finally rofased food alto- gother and died. T'o satisfy himse!f Mr. Gibhle opened the body of tl:c animal and found but four bots or worms, but still the stomach was almost entirely eaten away, He was still at a loss to de- termine the cause of this, as, together | with others, he had never considered the snowy incrustutions appearing in Jlaces upon the ground other than a Ikind of harmless alkah. One day he was passinganewlyout blufl from which this substance a peared in con ider- uble quantities, when curiosity prompt- od him to taste He only touched his tongue, and found it rather sweet in taste and as first apparently harm- ess. In an hour or two, however, his wun to swell and burn, and this inflanmation continued two or threo days, resisting all soothing ap- plications. Finally the inflammation subsided, almost as quickly as it came, and his tongue and mouth gradually healed A fow weoks previous to this, James Wescott, a farmer living four mles west of Kakota City, was attacked with a peculiar internal ailment. He was 1l twoor thres days and then suflvred intense pain for a week, when he died. All possible efforts were made to relieve him, but none of the remedies used seemed to affect any- thing. A post mortem examination dis- closed his stomach to be much inflamed andeaten awayin places. The surgeons pronounced it a case of poisonir but by what particular poison th were unable to discover Mr. Gib- bles says that he is satisfied, as are the members of Westcott’s family and his friends, that the unfortunate man had been drinking water from a slough, where the poisonous forma- tion existed. A rather strange fact connected with this poisoncus encrustation is that cattle like " it, and lick it up, without being injured. Gibbles thinks that the poisonous propertics are taken into the stom- achs of the horses in water forming in pools on the ground where this ma- terial appears, during wet weather; as all of the animals he has lost have been taken sick during or after heavy fails of rain. At such timesa num- ber of animals throughout that sec- tion of the county always are laid up and many die, despito the most sirenuous precautions. As yet no remedy has been found. A successful antidote for the poison would be alike a ble « to the farmers and a anza for its discoverer. e FERSONAL- E. hon- Licut, W Sidney. Max capital AW, a brief v Cha itin O .
