The following new appointment- ments have been made in the railway mal service: Frank P. Wellman, Omsha and A STOLEN STEED. The Question Is, Who Stole Him, and Who Pays the Damages. A case was tried cn Thursday last in Justice Riley's court wwhich is one of the most peculiar and complicated for the amount involved that bay ever been tried i that court. The factsin the matter are as follows: On October 10tb, 1878, Mr. Georze L. Redman, reeiding at Waterloo, lost 8 gray horse valued at about $150. The lost horse was advertised in TuE Bee and Republicsn at the time, but no information was received. Mr. Redwan was in the city this spring, and while walking up one of cur strects saw horse, which appeared to be lika the one he had lost, attached to the delivery wagon of Dewey & Stone, Ugon further examinaticn he found sundry marks which corvinced him that the horse was the identical one stolen. Suit was accordingly commenced for the animal, and Mr. E. M. Bartlett was engaged as atiorney. The defense claim on trial that they bought the horse of a man named Wolcott. Woleott is alleged to have bought the horse of a man by the name of Thompaon, who, it is claim- ed, bought him of a periy named Haney. Haney says he bovght him in June, 1878, cf a man named R nolds, who claims to have purchassd him of a party in Towa in the same year. Proof that Wolcott purchaced the horse of Thompson, or that Thomp- #on sold to Wolcott, seems to be Jazk- ing. It appears that Wolcott hai a matched team of grays, and in all probability he was the horse now clasimed to have been purchssed by Haney. At all events there two mise- ing Iinks in the chain of title set up by the defendants, while by marks and ecars aud proof by the gentleman wko owned and raised the horse there was left no doubt as to bis identity as being the same horse lost by Mr. Red- man. Justice Riley decided in favor of the plaintif. Dewey & Stone wee com- ! pelled, to protect themselves, to con- test the case, but losing, they have re- courze to the man of whom they pur- chased, The costs of the trial Lave already sggregated at least as much as the value of the horse, and as the case has been sppealed to the district coutt, a rich feast for the lawyers is evidently in store. Have reduced the price of all kinds of Notion Farine, at Pundt’s. A SERIOUS CHARGE was made against Willis M. Yates by an old citizen because his children eat too much bread msde from Rush Esgle Mills Flour, but when Mr. Yates convinced the avgry man that nice bread was cheaper than a pocroxs B1LLit was O. K. The suction at Whipple & Co. is proving a grana success. Parties making purchascs koow that goods are just a3 represented with as gocd guarautee as if Fought at private sale. Base Ball. The Red Stockings and the Uui- versities, at the association grounds, Flayed one cf their leagne games Sat- urday afternoon. Seven innings wero played, the Reds defeating the "Vars- ity nine. The score was 41 to 17. The victors were two men short throughout, while the ’Varsitios had a complete nive. Miss Hendricks' Benefit Did not draw as full a house as the circumstances of the cate and tke merits of the piay deserved. The “Ticket-of-Lesve Man” was well rendered, considering the fact that most of the actors were amatears, Miss Hendricks' ‘May Edwards” is pronounced by msny who witnesred the performance to be fully as good as Mrs. Florence's, and that lady has made the character a specialty for sears. Miss Hendricks was still suf- feriug from the effects of her reccnt accident and a slight lameness some- what marred her part, but her wan features and convalescent appearance rather improved the general effect. Yesterday sfterpoon a crowd of young fellowe, ameng whom were the notorious Tuttle boys, raised quite a disturbance around Pat. O'Toole’s place, on the corner of Thirteenth and Harney, and one of the outfit smashed a window in the front of the saloon. Marshel Wosterdabl appeared cn the scene and took the glass crusher {in cus'ody. When on the corner of Fifteenth and Farnham sirvests, tho chap hit the marshal a severe blow, and making a bresk ran with the epeed of a deer arcund the cornor of the alley in the rear of Paxton’s & Gallagher's wholesalo grocery store. Assoon as the marshal could collect himself, be zave chase, and dashing around the corner of the alley found the fellowin the Tear of Jacob's un- j dertaking store, crouched behind & barrel with a couple of boards over him. Polling his revolser, the marshal told him to ccmo out if he didn’t want > be shot, and he came. He was nveyed to the jail without further mishap, and placed under the charge of the turnkey, whom he dared to fight him. The afterncon was devoted to an insiramental iwusical concert at the hall. Atan esrly hour in the evening the gardens attached to the hall began to fill, and before 9 o'clock there was scarcely standing room. Ths strains of the orchestra and the click of the glasees were merry music tp Teutonic ears. Good humor was portrayed on every face, and even Mayor Chase, In faultless attire, was thoroughly at home in the crowd. Atths termination of the evening concert a grand march to the ball- room, where the light fantastic was tripped till the wee zma’ hours, con- elnded ote of the most pleassnt and successful fetes of the season. Sundsy School Concert. The Sunday-school connected with the Eightconth street Methodist church, gave a concert last cvening.
