Yesterday a.m. felegrams from Washington announced that at the conclusion of Senator Chaffee’s re- marks on his resolution regarding the management of the Union Pa- cific railroad witb reference to pro rating with the Kansas Pscific and Denver Pacific, ete., Senator Saun- ders sent to the clerk’s desk aud had read & telegram from A. J. Popple- ton, attorney for the Union Pecific railroad, tkat the question whether the Kansas Pucific, Denver Pacific, and Burlington and Missouri River rosds were branches of the Union Pacific and what their rights were, was now pendiog before Judge Dillon and s discussion might be expected in afew days aud expressivg the hope that there would bano legis tion until after the decision should be made. Senator Saunders eaid he desired to address the Senate in regard to this resclution,but was not prepared. Senator Chaflee then yielded and the resolution was laid oyer for the present. The telegram from Mr. Poppleton in relation to Benator Chaffes's res- o'ution referred to'a suit now pend- ing in the United Htates Circuit Court, now in session in this city, Judge Dillon presiding. The suit was brought by the Kausas Pacific and Denyer Pacific railroads against the Union Pacific, to compel the Union Pacific to pro rate with those roads on business delivered by them to the Union Pacific at Cheyenne. By the term “pro rate,’ they mean the right to have their business carried from Cheyenne to Oglen at mileage pro rata of the lowest through rate from Omaha to Ogden, which is one-half the through rate, Cheyenne being equi- dietant berween Omaba and Ogden. This it was commenced about two years ago and asa bill in equi- ty to enjoin the Union Pacific from discriminating agaiust the Kansas Pacific and Denver Pacific by refus ing such prorata. Tue question whether the Union Pacific is d to sny increase of rate west of Cheyenne, by reason of inc-eased ecost of construction and operation of the road, and the ques- tion whether the Kansas Pacific and Denver Pscific constftute a branch Usion Pecific, asraiced by ex- ceptions filed by these companies to the auswer of the Uszion Pacific, will be argued to-morrow morning. The guestions raised are regarded of very great importance, and emi- nent tegal talent is employed on both sides. Judge Usher of Law- rence, Kaneag, and Mr. Holmes, of New York, and Hon. J. M. Woolworth, of Omala, repre- sent the Kaneas Pacific and Denver Pacific. Hon. A. J. Grace vs, Connolly—The Plalntiff Awarded $50 Damages For a Broken Coflar Bone, The jury in the casé of (irace vs. Connolly et sl., brought in & ver- dict yesterdsy for the plaintiff giving him $50 damages for a bro- Ken collar bone received while en- gaved in a fight with the Counolly family. This was rather an amuping trial. Grace, while on the stand, shocked the dignity of the Court by the fre. quent use of profanity, his oaths generslly being hurled at Mr. N. J. Barnhara, counsel for the defendant. ‘the Court severely reprimanded bim for it, and finally threatened to stop the suit ir he did not discontinue it, and intimated also that he might be invited to etep down into the basement behind the bars for con- tempt. Alfter the trial was over Juoge Savage called Grace up and talked to him, and concluded by saying, *I think perbaps you had better not come before this court any more. That’s all the punish- ment I shall inflict upon you now.” Some people might consider it a beavy puaishment to be barred out of court, but whether Grace takes it that way is question. Connolly,during the trial, claimed to ba deaf, and insisted that the counsel should sit close to him. Mr. saldwin, counsel for Grace, put his aaricular powers to a test, by going towards hitm, and asking a few ques- ton in a very low tone, which he answerea promptly. Thereupon the Court becamo satisfied that he was not o deaf as he might be, and that 10 car trumpet was necessary. o he ordered Mr. Baldwin to resume Lis place ata distance. Parsuit and Capture of the Thief Quite s heavy robbery was com- mitted at the Eagle house, on Four- teenth street Tuesdsy night. A man named Wilbelm Fried, 8 Polander by birth, and a companion whose name we have not been able to ascertain, arrived in the city Tuesday from New York, and putup at the Esgle house. Both were fresh from Earope, having recently been discharged from the Prussian army, and neither could talk a word of English. Fried had $475 {in money aud a gold watch and chain. Both men occupied the same 100m, and early in the morning,whenFried woke up, he found his companion gone, together withs his money and wateh and chai The robbery Was at once reported to policeman MeAuliff, who noti- fied City Marshal Butler of the cir- camstances. Butler rushed off without his breskfast, and obtaining a carriage he took with him Charles Fleck, proprietor of the hotel, and drove out to Gilmore and Pappiliion at a rapid rate, after having first telegraphed to those points. Not finding their man there, they started on their return, coming in on the Bollevue road. Arriving st tue “Half-way House,” Marshal Butler thought it would be a good idea to take a look inside. On entering the place the very first man that Butler and Fried eaw was the thief himself. Hestarted out at the back door and bounded awsy like a dcer, with the Marshalin hot pursuit, and theofficer finally ran him down a'ter a lively chase. Oa searching him the sum of 3330, wis found. It seems that the thief had hired some one to drive him out of town towards G I+ more, and that afterwards he had taken a beck track to throw his pur suers off the ecent. The prisoner was brought back to Omaba in the afternoon and lodged in jail, where he will be likely to remain for gome time to come. Marshal Butler deserves coneid- erable credit for the successful cap- ture.
