A, baseball team, charged with false pretense. ‘Ernest Bernard, the complain- ant, testified that &, year ago he borrow- ed from Hamei, for another party, & baseball sult, the property of the Amer- ican Thread A. A. Baseball team, with thie agreement that it the sult was not returned he (Bernard) would stand \the price of the suit. The season was well advanced when Hamer demanded the sult but at the time Bernard was unable to secure it from the party for whom he had borrowed it. He made good his agreement and paid the price that Hamel asked, which amounted. to $65. Some time ago Bernard managed to recover the Baseball suit and then called on Hamel to return the money paid him. This, he said, Hamel refused to do. Bernard was of the opinion that he wi overcharged when he paid §65 for a second hand suit. The latter died recently and ‘then the matter was taken to the prosecuting at- torney. George Wakulsky, a Mansfield milkman, the complainant in the case, testified that he called at the Ieiss home. The two men appeared in the Franklin town court as a result of an automobile accldent in’which they figured Thursday night on the state highway, a short dis- tance south of Willlams crossing. The men were aceompanied by two women and rode in a Chevrolet. They wers on their way to Norwich. . Mike Youchek, - of Franklin, in his Ford car was coming to- ward Willimantic. Youchek sald that he notced the other ‘éar coming at a fast rate and keeping to the middle of the road.
