Voting Districts The City of Norwich shall be divided into six voting districts which shall be the legal yoting Districts at all City Flec- tions. Central District. SECTION 5. Whe May Vote at City Elections, Bvery elector in this state, residing in the City of Norwich, at the time of any City Election, and having resided in said city for four months. next precsding said election, and who was registered on the corrected list of voters of the Town of Norwich Jast before completed shall be entitled to vote and no other person shall vote at said election and each elector shall be entitled to yote only in the dis- trict whose list contains his name, Any elector entitled fo vote at sald election but whose name appears on said corrected list as residing outside the lim- its of sald city shall be, nevertheless, en- titied to vote, but only fn the district in \which he resides at the time ot sald slec- fon. L.Any such Special City Meeting shall b lied to take action upon any remon- I'strance to the passage of any ordinancc or ordinances by the Beard of Alderme: of spid eity, as provided in Sectlon 98 1his charter; or to take action u-on any recommendation, previously adopted by sald Board of Aldermen, to dispose of any roal estate owned by sald city, or to fe- quire any additional real estate for sald city, s provided in Section 129 of th: charter ; or to take action on any recom- mendation, previously adopted by said Board of Aldermen, to issue Municipal Bonds in addition to such Munioipal Bonds as are already out-standing, as provided in Section 130 of this charter or to take action on any other matter or matters, not specifically provided for in this charter and previously deemed de- sirable and necessary by said Board of dermen. i SECTION 7, Predecessors Con- tinue in Ofe At each sald blennial election held at such hours and places as hereinafter pro- vided, the electors of sald city shall choose the following officers to Wit:—aA Mayor, a Clerk, a Treasurer, & Ooliector, two Sheriffs, and four members of the Board of Water Commissioners who shall hold their respective offices for a term of two years from the first day of January next following sald election ard until] their successors shall have been chosen and qualified. v ‘The incumbents of said offices, at such time as this charter shall become effec- tive, shall hold office until the first day of January in the year 1923 and until their successors shall have been respec- tively chosen and qualified. SECTION 8. Aldermen Elected. At each said biennlal election, so held as aforesald, the electors of said City shall choose eleven members of the Board of Aldermen as follows:— The Central District shall choose three members residing in said distriet The West District shall choose twe members residing in said district ; The North District shall choose two members residing {n said district; The Greeneville District shall choose two members residing In said district ; The East District shall choose one member residing in said district; The South District shall choose one member residing in said district. The eleven members of said Board of Aldermen, s chosen. shall hold office for the term of two years from the \irst day of January mext folowing said election and untll their successors shall have been respectively chosen and qual- ified. The members of the Court of Com- mon Council of sald city, in office at such time as this charter shall become effective, and the several committees and appointees of saig Court shall hold office until the first day of January in the year 1928 and untll thelr successors shall have been chosen and qualified. SECTION - Places and Hours of Clty Elections. The Court of Common Council for the first blennial election to be held in sald city on the first Monday in the menuth of December in the year 1922, as here- inbefore provided, for the election of of- ficers and aldermen in the several voting distriots of sald city, shall by ordinance or by law onor before October 1, 1922, fix ‘the places where such election skall be held and the hours for the opening and closing of the polls in said districts. Biennially after said first Biennlal Election, all elections of officers and al- dermen in the several voting districts of said city shall be held at such places and at such hours as the sald Board of Al- dermen shall prescribe by ordinance, by- laws or otherwise. At every Blennial Election, so held as aforesaid, each of said officers and al- dermen shall be chosen by plurality vote and the officers so chosen shall be publicly declared to be elected by the presiding officer of the Central Voting District, and by him certified to having been elected to the City Clerk, But if by reason of an equality of votes, there shall be no choice of any of sald officers and aldermen, then the Board of Aldermen shall provide for the holding of a_new election within thirty days from and after the time when such failure to elect shall be made known. * In case of the death, incapacity,resig- nation, removal, refusal to serve or qual- ify %of any officer, excepting those of- ficers chosen as provided by this charter ifyvof any officer, excenting those of- shall fll such vacancy by appointment for the unexpired term. All vacamcies in any office, by reason of death, incapacity, resigna- tion, removal. refusal to serve or qual- ify of any person required by this charter to be chasen by the clectors shall be filled at a regular or at a speelal clection called and held in the same manner and form and subject to the provisions of this charter applied to reg- ular elections. Said special election shail be cajied and held within one hundred and twenty days, except for a vacancy in the office of Mayor, after the death, res- ignation, incapacity, removal or refusal to serve or qualify of any person chosen by the electors. Pending elther a regu- lar or speclal election to fill such va- cancy the Mayor may designate or ap- point an elector of the city to such va- cancy by lodging With the city clerk a certificate of such appointment except nothing.in this charter shall authorize or empower the Mayor to fill any vacaneles existing for any cause ¥ the Board of Aldermen. The elector 50 appointed by the Mayor' shall ‘duly qualify for such oftice and shall exercise during the term for which he has been.so appointed all !the powers and discharge all the duties of sald office until the election and qual- ification of his succes: SECTION 18 Vacancy in Office of Mayor. Whenever the Mayor shall die, re- slgn, be removed from office, Tetuse to qualify, or permanently remove from said eity, another shall be chosen fn his place Dby the electors of sald city at a regular or special city election, within thirty days from the date of such difjualification, and the person chosen as Mayor at said election shall continue in office for the same time as the person whom he sue- ceeds would have done if he had not dled, resigned, been removed from office, r fused to qualify, or permanently r moved from said city.Whenever there shail be a vacancy in the office of Mayor or whenever that officer shall be tem- porarily absent’from the city or bre- vented by sickness or other cause from attending tc the dutles of his office, the president of the Board of Aldermen or, in event of his absence or disability, the vice-president of sald Board shall act as Mayor and shall possess, use, exercise and enjoy all the rights and powers and perform all the duties of the Mayor dur- ing the ¢ontinuance of such yacancy, ab- sence or disability. And the person administering such eath or affir- mation shall give a cortificate thereof | the person to whom he administered i which certificate shall be recorded in the records of said city before the person t ‘whom it is given shall be qualified to ex ecuite the office to which he has beer chosen, SECTION 1%, Mayor. : The Mayor shall be the chief executive officer of sald clty, and shall have beeq a legal voter and resident of said city far the five years immediately préceding his election and shall reside m the eity dur- ing his term of office. SECTION 18 Daties of Mayor. Tt shall be the duty of the Mayor:— Tos cause the laws and ordinances to Dbe executed and enforced, to inform the City Attorney of all violations of law brought to his attention and to conserve the peace within said city. He shall be responsible for the good order and efi- clent government of said city. To fll by appointment ofiices and va- cancies in all elective or appointive offices to sald city, and to report, In writing, al. such appointments to the Board of Alder- men at the meeting thereof next follow- ing said appointment To communicate 1o the Board of Alder- men Quring the month of July next suc- ceeding his election, and quarterly, ther after, a general statement of the condi- tion of the clty in relation to its govern- ment, finances, publie improvements, and affairs, with such recommendations as he may deem proper ; To ‘call speclal meetings of the Boar: of Aldermen when he may deem it ex pedient ; To sign all bonds, notes and deeds and all written contracts of the city made in accordance with this charter or the ordinances and not otherwise speciiically provided for ; To call together, at his discretion, for consultation and advice upon the affairs of the city any or all commissioners, offi- cers, superintendents and directors of the several departments of the ecity and at such meetings he may call for such re- ports as he deems necessary and advis- able; To either approve or disapprovs, in writing, every vote, resolution, order o: ordinance passed by the Board of Alde men. 1f he approve it or fafl to tak action within ten days after the passage thereof, such vote, resolution, order or ordinance passed by the Board of Alder- men shall become operative and effective. In case the Mayor shall fail to take ac- tlon upon any vote, resolution, order, or ordinance passed by the Board of Alde men, within ten days after the passage thereof, the City Clerk shall endorse the fact upon the vote, resolution, order, or ordinance. If he disapprove it he shal notify the City Clerk of that fact, and he shall transmit in writing his reasons for such disacproval to the body in which | originaied at or before its next regular mecting, and such vote, resolution, order, or ordinance shall not become opeative and effectual unless rassed over his veto, by’an affirmative “yea” and ‘nay” vote of two-thirds of all the members of tho Board of Aldermen, present or ab: The Mayor may also approve or di Dprove any part of any vote, resolution, orde® or ofdinance, and the part of the vote, resolution, order or ordinance ap- proved shall become oberative and ef- fectual, and the part disapproved shall be vold, unless passed over his veto in the ‘manner aforesaid. SECTION 14. Powers of Mayor. The Mayor shall have powe To assume entire control and direc- tion of the police and the fire forces of the city, or either of them for a period not exceeding five: days, at his discretio but only in case of emergency, and to =x ercise all of the powers conferred upon the fire and the police departments in re- lation thereto; To exercise, Whenever necessary to suy- press tumults, riots, or unlawful assem- ‘blies, within the limits of said city, all the powers given by Jaw to sheriffs in re lation to riotous assemblages; and at al times, when necessary, to require the ai of any sheriff, deputy sheriff, constable or policeman, or any or all of them t gether, to ‘assist him In executing t laws within the limits of said city; To ‘make requisition for the several companies of the National Guard in sai ¢ity, or any of them, whenever he shal ll‘ch reason to believe that great oppcsi tion will be made to the exercise of hi authority, and to exert all the force nec- essary (o enable him to execute the Jau: within the limits of said city; To apboint, whenever Le may deem it best to do 8o, three competent, disinter- ested persons, not all of the same politi- cal party, to examine without notice, the affairs of any department, officer, or em- vloyee of gaid city, and submit the re- sults of £ald examination to him; The Mayor may at any time whenever he may believe any person appointed to office by him or-any of his predecessors to be incompetent, or unfajthful to the duties of his office, or that the require- ments of the public service damand bis removal, summon sald officer hefors him at a place and time specified in said sum- mons, to show cause why he should not be removed from his office. With such summons he shall leave with said officer & written statement of the charges against him. and f, after full hearing, he shall find that such officer 1s incompetent or unfaithful, or that requirements of the public service demand his removal, he may remove such person from his ofice. Notice of sach removal shall be given by sald Mayor in writing to the officer so re moved, who, if agrieved by such removal may, within ten days after recelving said notice, appeal therefrom to the Sugerior Court for New London County, which shall hear such aopeai and render fudg- ment thereon, But no such officer 3o ro- moved shall exercise any of the powers Of his office durimg the pDAat 1o SAd ot NeL of Mla i SECTION 15, any person shall hinder, obstruct resist or ajuse the Mayor In the: esens: tion of his office, or when orderea (o render assistance to the Mayor (being of suflicient age and ability) shall refuse or neglect to do so, such offender, being thereof duly convicted, shall pay a fin not exceeding one hundred. dollars, or shall be imprisoned in the county jail not exceediE six months, or both, at the dis- cretion of the court having cognizance of the. offense, SECTION 16. Corporation Counsel, , Additional Counsel, The Corporation Counsel, in office at such time as this charter shall- become effective, shall hold office until the first day of January in the vear 1923 and until his successors ehall have been ap- pointed anl qualified, * 2 There ghall be in said city a Corpora- tion Counsel, who at the time of his op- intment shall hiave been an attorney and years after his appointment successor shall have been appoint aqualified. ‘ SECTION 17. The sald Cogporation Counsel, appoint- 'ed as aforesaid, shall by the legal.ad- viser of the city and its departments, and 1t shall be his duty to represent said eity in all civil actions in any court wherein sald city is intevested, and to give his written opinion when so requested upon any legal question which may be ‘Sub- mitted to, him by the Mavor, or by the Board of Aldermen, or the chairman of any committee of the Board of Alder- men upon any subject pending before said committee, or by any department, or by. any public official with the written cof- sent of the Mayor. ~All opinions So given by-him shail be recorded in an in- dexed book, which book shall be kept in the office of the City Clerk and shall be the property of the eity, and such opin ions as the Mayor shall direct shall be published in the year book issued next after such opinions are given. He shall, when £o_directed by the Mayor, or the Roard of Aldermen, represent the city in all matters pending hefore the geperal assembly, affecting ‘the Interests of sald city, and he shall perform all other legal services which may be required of him by the Board of Aldermen or by law or ordinance, He shall annually, on or be- fore the first day of Febryary make & written report to the Mayor of his doings for the fiscal year next preceding, show- ing the condition of all unfinished busi- ness In his hands, and he shall at any other time give to the Mayor all further additional {nformation that the Mayor may desire in regard to sald counsel department. SECTION 13, _ The Mayor may flll any -vacancy in said office and he may employ substitute counsel or he may employ additional counsel, if in his opinion, the interests of the city require it. . SECTION 18, Controller. There shall be a Controller of sald eity who, on the first day of January in the year 1923 and biennially thereafter, shalTbe appointed by the Mayor wih the approval, in writlng, of a majority of the members of the Board of Finance, ex- clusive of said Mayor gnd sald Con- troller. The Controler, so appointed. shall hold office for a term of two years from the time of his appointment and until his successor shall have been appointed and qualified. 'The Controller shall, under the charter and the ordinances, be sub- Ject to the general direction of the Board of Finance of said eity in all matters re- lating to the financlal affairs of the city, except as herein otherwise expressly pro- vided. " The Controller, whenever absent or otherwise incapable of acting, mayyby appointment in writing, approved by the Board of Finance, filed in the office of the city clerk and recorded in the rec- ords of the city, designate a clerk in the Controller’s office to act as Controller, and when 5o appointed and acting there- under, said clerk shall have and exercise such of the powers, duties, and author- ity of the Controller and only such, as may be specified in said appointment, un- less and until revoked by cither the Con- troller or sald Board of Financs, in writ- ing, filled and recorded, as provided for said appointment. SECTION 2. He shall keep, in suitable books, ac- counts with each of the city departments, with such of the city officers as may be designated by the Board of Finance, and such other accounts as the clty ordi- nances or said Board of Finance may di- rect. SECTION 21. He shall, subject to approval of the Board of Finance, preseribe the form of all accounts and of all Teports to be ren- dered and shall have the ingsectionand su- pervision of the accounts of all other de- partments and officers, and provifie all books, stationery, and oftice supplies nec- essary for their use. % SECTION 28, first day of each month the accounts of the several departments and all of sald ofticers who receive, pay out, or dispose of the money or other property of the city; shall make proper comparisons of the same, and report his findings to the Mayor and a duplicate thereof fo the Treasurer; he shall daily audit the cash account of the Treasurer for the last previous day, and certify at the foot of said account as to its correctness, and shall subgit to the Mayor on or before the twentieth day of January, the twentjeth day of April, the twentieth day of July, and the twentieth day of Octo- ber In each year, a report of the con- dition of each of said accounts, together with & summary of all accounts of the city, verified by his oath or affirmation, exhibiting the revenues, receipts. and ex- penditures, the source from which the revenues, and funds are derived, and in what manner the same have been dis- bursed, and the amount drawn against each item of the appropriations, and the Mayor shall cause sald reports to be sub- mitted to both. the Boeard of Aldermen and the Board of Finance. SECTION 23, He shall keep a separate aceount for each specific item of the appropriation for one item of expenditure to be drawn upon for any other purpose, or by any department other than that for which the appropriation was specially made, ex- cept in case of transfers made as here- inater provided. .No order on the Treas- urer shall be issued unless sufticent funds to pay the same shall actually be in the he shall certify any bill, , or claim in excess of appropria- tlon properly applicable thereto, the city shall not be llable for such excess, but he shall be personally liable therefor, and his sureties, shall also be liable to the amount of his bond. SECTION 24, Fach claim or account against the city hall be first verified by the oath or af- firmation of the claimant or his agthor- 1zed agent, it required by the Board of Finance, then eertified to be correct and justly due by the officer or board by Whom, or under whose authority, the same was contracted. Such elaim or a count shall then be transmitted to the Controller, who shall carefully examine and compute each bill rendered, and on finding it correct, he shall sp certify, and then lay it before the Board of Finance for approval, and no bill shall be nald untfl approved by a majority of said Board of Finance in writing. If any claimant is_indebted to said city the Controller shall report such indebtedness to sald board, together wWith the claim. Notice of the audit shall be given by the Controller to the officer or his legal rep- Tesentatives before the final statement of the account, and, if desired by such of- ficer or his legal representatives, oppor- tunity shall bs given for a hearing. A copy of such notice, with an affidavit to the fact of service thereof, shall be filed, with a statement of account, as cvidence of service of motice. SECTION 2%, . SECTION 38, The Treasurer shall pay all probver orders drawn on him by the City Clerk, and countersigned by the Controller, and also all orders drawn on him by the Board of Gas and Electrical Commis- sioners. ‘The. Treasurer shall report to the Board of Finance, on the first of eash month, the amount of momey belongl to said city in his hands, and the sources from® which it was recelved, and shall present to said board each month his ac- counts ‘for the month next preceding, properly audited and certified by the Con- troller. SECTION 34, City Collector. The City Collector, in office at such time as this charter shall become effec- tive, shall hold office until the first day of Januery 1923 and until his successor shall have been chosen and qualified. There shall be in gaid city a Collector, elected as hereinbefore provided. He shall have all the power and be subjact to all of the duties imposed by law ypon collectors of town, city end school dis trict taxes.
